我国农民工法律援助制度:意蕴、困境与优化路径——基于西安市区农民工生存状况的调查研究

【摘要】：农民工法律援助制度是中国特色的法律救助机制和特殊的法律援助形式,具有典型的时代转型性和农民工群体特性。农民工法律援助制度有其内涵逻辑和价值意蕴,但也存在制度性、操作性局限,笔者以西安市区农民工的问卷调查数据为支撑,对农民工法律援助制度的困境进行了制度、程序、经费和主体层面的解读,并认为坚持健全制度、强化保障、完善渠道、加大普法的"四位一体"路径是当下优化农民工法律援助制度的应然之举。
[Abstract]:The legal aid system of migrant workers is a special legal aid system with Chinese characteristics, which has the characteristics of the transition of the times and the group of migrant workers. The legal aid system of migrant workers has its connotation logic and value implication. However, there are institutional and operational limitations. Based on the survey data of rural migrant workers in Xi'an urban area, the author interprets the plight of the legal aid system of migrant workers from the aspects of system, procedure, funds and subject. The author thinks that it is necessary to improve the legal aid system of migrant workers at present by insisting on perfecting the system, strengthening the guarantee, perfecting the channel and increasing the "four-in-one" path of popularizing the law.
