【摘要】： “法律与文学”被称为法学交叉学科理论研究中最令人兴奋的学派,它以“法律”与“文学”之间的关系为核心,力图颠覆传统法学的研究模式,建构起一门新型的跨学科领域。在法学领域,一般将其视为后现代法学队伍中最为重要且极具代表性的一个学派,它不仅给法学研究带来了新鲜与活力,亦同时表明了后现代思潮在法学界的兴旺与发展。本文以匡正“法律”与“文学”之诸关联模式为起点,通过对诸模式及其关系的考察,确立了审视“法律与文学”的后现代视角;并以理解后现代及后现代法学为前提,建构起间接性后现代哲学基础与直接性后现代哲学基础的理解模型,重点探讨“法律与文学”的后现代思想基础;随后着力讨论“法律与文学”之两大论域,即“文学中的法律”与“作为文学的法律”中所展现出来的后现代主义特质。最后,将目光集中在中国的“法律与文学”及后现代研究,揭示其限度与价值。
[Abstract]:"Law and literature" is known as the school of the most exciting research interdisciplinary theory, it takes "relationship between law" and "Literature" as the core, to subvert the traditional research mode of law, construct a new interdisciplinary field. Based on the rectification of "law" and "Literature" and the associated pattern as the starting point, through the investigation of the the patterns and relationships, established a review of "law and literature" postmodern perspective; and to understand the modern and postmodern jurisprudence is the premise of understanding the model construct and direct indirect basis of postmodern philosophy basis of postmodern philosophy, heavy Discussion on "law and literature" the postmodern ideological basis; then discusses the "law and literature" two universes, namely "law in literature" and "law as Literature" to show up in the post modernist characteristics. Finally, focus on China "law and literature" and after the modern research reveals its limitation and value.
