董必武法制思想探究

【摘要】：董必武法制思想是在半殖民地、半封建社会的历史背景下，以马克思、列宁主义为指导，紧密结合新民主义革命和社会主义革命及建设的实践而形成和发展起来的。董必武对法制如何服务于社会主义革命和建设，进行了积极探索和科学论断，形成了一系列经得起历史和实践检验的法制理论体系和指导方针原则，董必武法制思想博大精深，系统全面，是毛泽东思想的重要组成部分，丰富和发展了马、列主义的法律学说。目前，学术界主要集中于对董必武的立法、司法、守法、法学研究和法律教育等方面的某一主题进行论述和研究。在现有研究成果的基础上，本文采用叙论结合，理论联系实际，历史与逻辑相统一的研究方法，在唯物论和辩证法的指导下，对董必武的法制思想进行科学的梳理和分析。力图在系统研究董必武立法、司法、守法、法学研究和法律教育等方面内容的基础上，实现对董必武法制思想的系统把握和科学评价，达到为依法治国方略的实施，提供丰厚的理论前提和实践指导的目的。 本文分为四个部分： 第一部分，简单说明了本文的选题缘由、研究方法，并对当前的文献和研究成果作了简短综述。第二部分，对董必武法制思想形成的历史背景和理论渊源及发展历程进行了阐述。第三部分，对董必武法制思想的基本内涵，从立法、司法、守法、法学研究和法律教育等方面进行论述。第四部分，结合董必武法制思想的基本原理与当前我国法治建设的现状，对学习和研究董必武法制思想的现代价值和现实意义进行阐述。结束语部分，以实事求是的态度和辩证发展的视角，，对董必武法制思想及其所存在的历史局限性进行简明的科学评述。
[Abstract]:Dong Biwu's legal thought was guided by Marx and Leninism under the historical background of semi-colonial and semi-feudal society. Formed and developed in close combination with the practice of the New Democracy Revolution and the Socialist Revolution and Construction. Dong Biwu made positive explorations and scientific judgments on how the legal system serves the socialist revolution and construction. Having formed a series of legal system and guiding principles that can stand the test of history and practice, Dong Biwu's legal system thought is extensive, profound and systematic, which is an important part of Mao Zedong's thought and enriches and develops Ma. At present, the academic circles mainly focus on a certain subject of Dong Biwu's legislation, judicature, law-abiding, legal research and legal education. Under the guidance of materialism and dialectics, this paper combines theory with practice, combines theory with practice, and scientifically combs and analyzes Dong Biwu's legal thought. On the basis of judicial, law-abiding, legal research and legal education, the author realizes the systematic grasp and scientific evaluation of Dong Biwu's legal thought, and achieves the purpose of providing rich theoretical premise and practical guidance for the implementation of the strategy of governing the country according to law. This paper is divided into four parts:. The first part briefly explains the reason and research method of this paper, and makes a brief summary of the current literature and research results. The second part, This paper expounds the historical background, theoretical origin and development course of Dong Biwu's legal thought. The third part, from legislation, judicature, law-abiding, to the basic connotation of Dong Biwu's legal thought, Part 4th, combined with the basic principles of Dong Biwu's legal thought and the current situation of the construction of the rule of law in China, This paper expounds the modern value and practical significance of studying and studying Dong Biwu's thought of legal system. This paper makes a brief scientific comment on Dong Biwu's legal thought and its historical limitation.
