论当代中国的法治精神

【摘要】： 法治精神是人类法治实践的产物,是人们对法治所蕴含的被实践证明有益于人类社会健康发展的本质、价值等的主观把握成果,具有普适性、民族性和时代性。当代中国法治精神的要素主要包括法律至上精神、理性精神、平等精神、自由精神、权利精神、权力制约精神、民主精神、共和精神、公正精神、和谐精神、人权精神等。法治精神的要素不是一成不变的,本文从时间、空间、系统论的视角对其进行了深入分析。建国后很长时期,在阶级斗争工具法律观的支配下,我国法治观念淡薄。在总结法制建设经验和教训的基础上,党的十一届三中全会以后,我国的法治建设逐渐步入正轨,依法治国观念逐步形成,并初步树立了社会主义法治理念。法治精神是法治的灵魂,建国以来法治建设的经验和教训以及我国法治精神的缺乏现状决定了弘扬和培育法治精神已经成为我国法治建设的首要任务。我国弘扬和培育法治精神的目标是将作为时代精神的法治精神升华为民族精神,最终生成中国特色社会主义法治精神。本文最后论述了我国弘扬和培育法治精神的途径:遵循法治精神的成长规律;探寻我国法治精神缺乏的成因;探索弘扬和培育法治精神的具体路径;充分利用弘扬和培育法治精神的资源。
[Abstract]:The spirit of the rule of law is the product of the practice of human rule of law, and the subjective grasp of the essence and value of the rule of law, which has been proved to be beneficial to the healthy development of human society by practice, is universal. The main elements of the spirit of rule of law in contemporary China include the spirit of supremacy of law, the spirit of reason, the spirit of equality, the spirit of freedom, the spirit of rights, the spirit of power restriction, the spirit of democracy, the spirit of republic, the spirit of justice and the spirit of harmony. Human rights spirit and so on. The elements of the spirit of rule of law are not invariable, this article has carried on the thorough analysis from the angle of view of time, space and system theory. A long time after the founding of the people's Republic of China, under the domination of the legal view of the tool of class struggle, On the basis of summing up the experience and lessons of the legal construction, after the third Plenary session of the 11th CPC Central Committee, the construction of the rule of law in our country gradually entered into the right track, and the concept of governing the country according to law gradually formed. The spirit of the rule of law is the soul of the rule of law. The experiences and lessons of the construction of the rule of law since the founding of the people's Republic of China and the lack of the spirit of the rule of law in our country have decided that carrying forward and cultivating the spirit of the rule of law has become the primary task of the construction of the rule of law in our country. Sublimating the spirit of the rule of law as the spirit of the times into the national spirit, Finally, this paper discusses the ways to carry forward and cultivate the spirit of the rule of law in our country: follow the law of the growth of the spirit of the rule of law, explore the causes of the lack of the spirit of the rule of law in China; To explore the specific ways to carry forward and cultivate the spirit of the rule of law, and to make full use of the resources of carrying forward and cultivating the spirit of the rule of law.
