奥地利“精神打击”损害赔偿制度的最新发展及其借鉴

【摘要】：传统奥地利侵权法对"精神打击"案件受害人给予赔偿的立场相对保守。进入21世纪,奥地利最高法院通过一系列判决逐步建立起一套较为完善的"精神打击"损害赔偿制度,并推动了《奥地利损害赔偿法草案》相关条款的制定。《侵权责任法》中的精神损害赔偿制度能否适用于"精神打击"案件尚存争议。由于法律传统相近,奥地利"精神打击"损害赔偿制度的发展为我国相关制度的构建提供了有益的指引。
[Abstract]:The traditional Austrian tort law is relatively conservative in its position of compensation for victims of "mental strike" cases.In the 21st century, through a series of judgments, the Supreme Court of Austria has gradually established a relatively perfect system of "mental strike" compensation for damages.It also promotes the formulation of the relevant provisions of the Austrian draft Law on compensation for damage. Whether the system of compensation for mental damage in the Tort liability Act can be applied to the case of "mental strike" remains controversial.Because of the similar legal tradition, the development of the "spirit strike" damages system in Austria provides beneficial guidance for the construction of the relevant system in our country.
