【摘要】： 我国国民法律教育问题研究的目的是:探讨和梳理当前我国的国民法律教育实践,从理论的角度进行深入分析和科学论证,为国民法律教育工作的改善和提高提供理论支持。主要采用的研究方法是理论分析,逻辑推理,文献梳理,实证分析,对比研究等,围绕论题,综合采用上述方法,进行系统的研究。研究成果主要体现为从理论上把法律教育区分为法律职业教育和法律国民教育两种,在此基础上特别强调国民法律教育的基础性、战略性作用,指出国民法律教育在我国目前的研究现状不利于国民法律素质的培养和提高,也与建设社会主义法治国家的目标要求相距甚远。研究从深入分析我国当前的国民法律教育实践入手,从宏观的角度对国民法律教育的主体、形式、内容、实施等基本问题进行了系统分析,并进行了客观评价,其中对国民法律教育的范式研究是其中的特色,也是研究的创造性成果。同时,研究也注意到,国民法律教育的正当性和有限性问题,从理论上论证了进行国民法律教育的正当性、合法性,也从社会的角度,说明了国民法律教育自身的有限性。通过研究,提出了以后推进国民法律教育的具体建议,这也体现了作者对该问题认真思考的成果。通过研究,可以得出如下结论:国民法律教育问题在我国需要深入研究,但目前并未被法学学者充分关注和系统研究;当前我国的国民法律教育实践中,教育的主体、形式、内容、实施等方面都存在深层次的问题和不足,影响和制约了国民法律教育的实效;明确指出国民法律教育的未来转向应该是价值教育、问题教育、未成年人教育、宪法教育、社会教育和日常性教育。
[Abstract]:The purpose of the study is to probe into and comb the current practice of national legal education in our country, to conduct in-depth analysis and scientific argumentation from the theoretical point of view, and to provide theoretical support for the improvement and improvement of the work of national legal education. The main research methods are theoretical analysis, logical reasoning, literature combing, empirical analysis, comparative research and so on. The research results are mainly reflected in the theoretical division of legal education into legal vocational education and legal national education, on the basis of which special emphasis is placed on the basic and strategic role of national legal education. It is pointed out that the current research situation of national legal education in China is not conducive to the cultivation and improvement of national legal quality, and is far from the goal of building a socialist country ruled by law. Starting with the in-depth analysis of the current practice of national legal education in China, this paper systematically analyzes the main body, form, content and implementation of the national legal education from a macro perspective, and makes an objective evaluation of the subject, form, content and implementation of the national legal education. Among them, the research on the paradigm of national legal education is the characteristic and the creative achievement of the research. At the same time, the study also notes that the legitimacy and limitation of the national legal education, theoretically demonstrates the legitimacy and legitimacy of the national legal education, and also explains the limitation of the national legal education itself from the perspective of the society. Through the research, the author puts forward some concrete suggestions to promote the national legal education in the future, which also reflects the author's results of serious thinking on this issue. Through the research, we can draw the following conclusions: the problem of national legal education needs to be deeply studied in our country, but it has not been paid enough attention to and systematically studied by the legal scholars at present, the main body and form of education in the practice of national legal education in our country at present, There are deep problems and deficiencies in content and implementation, which affect and restrict the effectiveness of national legal education, and point out clearly that the future turn of national legal education should be value education, problem education, minor education, constitutional education, etc. Social and daily education.
