当代中国社会法制度建构的困境与出路

【摘要】：社会法作为新兴法律门类和法律学科,是我国近年来在落实科学发展观、完善市场经济法律体系、构建社会主义和谐社会的历史大潮中应运而生的,属于具有公法与私法融合特征的第三法域,是国家为解决各种社会问题而形成的,以维护弱者的权利和社会整体福祉为宗旨。社会法是社会的稳定器,是社会的安全网。虽然改革开放30年来,我国的社会法制度建设已取得了一定成就,初步形成了社会法体系,但到现在为止,我国社会法的法制化进程仍然较为缓慢,存在着一系列不容忽视的问题。本文正是在此背景下,在已有成果的基础上,研究社会法的产生和特质,分析当前中国社会法制度建构中存在的困境,提出理性构建社会法的一些建议,以期望能对社会法的制度建设、中国法治的建设及和谐社会的建设做出些许贡献。
[Abstract]:As a new law category and law subject, social law has emerged in recent years in the historical tide of implementing the scientific development view, perfecting the legal system of market economy, and constructing a harmonious socialist society. It belongs to the third jurisdiction which has the characteristics of the fusion of public law and private law. It is formed by the state to solve various social problems, with the aim of safeguarding the rights of the weak and the overall welfare of the society. Social law is the stabilizer of society and the safety net of society. Although the construction of China's social law system has made some achievements in the past 30 years of reform and opening up, and a preliminary social law system has been formed, the process of legalization of social law in our country is still relatively slow up to now. There are a series of problems that can not be ignored. Under this background and on the basis of existing achievements, this paper studies the emergence and characteristics of social law, analyzes the difficulties existing in the construction of Chinese social law system, and puts forward some suggestions for rational construction of social law. It is expected to make some contributions to the system construction of social law, the construction of China's rule of law and the construction of a harmonious society.
