清末修律中无夫奸存废之争研究

【摘要】： 对于男女之间无合法婚姻形式而私自两性交合所造成的社会问题,究竟该齐之以刑还是导之以礼?这对于曾长期存在的传统的中华法而言似乎不是一个问题。然而时至晚清,在被迫“法商化”的过程中,由于守常与思变的双重角力,礼与刑在维护社会秩序中的功能定位问题就成为一个亟需澄清的问题。清末修律中,礼教派与法理派的上层之“士”,作为统治阶层之中的被统治者,双方展开激烈而深刻的词语争夺,从而上演中国法制史上一段比较罕见的礼法论争。本文,以中国中世纪刑律中“奸罪”的法律表达及其伦理根据为缘起,接着先是间接考察清代民间两性婚外交往状况,继而通过清末判词考察奸罪的司法实践。然后选取三个历史点来论述无夫奸存废之辩:上迄清初“中国礼仪之争”,中置无夫奸存废之争,尾至中华民国旧刑法无夫奸除罪。最后,希望通过对无夫奸存废之争的考察重新认识礼法之争所反映的历史问题。
[Abstract]:As for the social problems caused by sexual intercourse without legal marriage between men and women, should they be punished or guided by ceremony? This does not seem to be a problem for the traditional Chinese law that existed for a long time. However, in the process of being forced to "legalize" from time to the late Qing Dynasty, due to the double struggle between observing the common law and thinking about change, the function orientation of propriety and punishment in the maintenance of social order has become a problem that needs to be clarified. In the late Qing Dynasty, as the rulers of the ruling class, the upper "scholar" of the ritual sect and the legal school, the two sides engaged in fierce and profound word competition, thus staged a relatively rare debate about etiquette and law in the history of Chinese legal system. This article, based on the legal expression and ethical basis of the crime of rape in the Chinese medieval criminal law, first indirectly examines the external intercourse between the two sexes in the Qing Dynasty, and then investigates the judicial practice of the crime of rape through the judgment of the late Qing Dynasty. Then three historical points are selected to discuss the argument of "the dispute of Chinese etiquette" between the former and the beginning of Qing Dynasty, and the debate between the former criminal law of the Republic of China and the old criminal law of the Republic of China. Finally, the author hopes to re-understand the historical problems reflected in the debate about the absence of husband and rape.
