翻译在应对法律语言模糊性中的策略

【摘要】：法律规定了人们的权利和义务，是人们为社会行为的指导规范，因此，法律规定必须明确清晰，不能含混不清，同样，作为法律载体的法律语言也必须准确、清晰。然而，事实却是在法律语言中存在着大量的模糊性词语、模糊性表述。模糊词语存在于法律语言中的原因很多，既有客观原因，也有主观原因，总之法律语言中使用模糊词语是不可避免的，因为模糊词语的使用有其特殊的无可替代的作用。既然模糊性客观存在于法律语言中，则作为法律交流桥梁的法律翻译就不得不对该问题予以重视。以往关于法律语言模糊性的研究主要集中在法律英语中，研究法律英语的模糊性及其翻译，从英译汉的角度予以探讨，而本文恰恰相反，本文主要分析中国法律语言中的模糊性现象，包括法律法规及司法语言等，从汉译英的角度予以探讨模糊法律语言的翻译。本文选取的例子来自中国的法律法规及司法实践，大部分取自刑法、民法通则及合同法，，具有一定的权威性和广泛性。本文共有四章，第一章简要介绍了模糊语言学理论；第二章分析了法律语言模糊性的原因；第三章分析了法律语言模糊性的积极功能和消极作用；第四章探讨了奈达的功能对等翻译理论，及在该理论指导下的模糊法律语言的翻译；最后对本文进行总结。
[Abstract]:The law stipulates people's rights and obligations, which is the guiding norm for people to conduct social behavior. Therefore, the legal provisions must be clear and unambiguous. Similarly, the legal language, as a carrier of law, must be accurate and clear. However, the fact is that there are a lot of vague words, vague expressions and vague expressions in the legal language. There are many reasons in legal language, both objective and subjective reasons. In a word, the use of fuzzy words in legal language is inevitable, because the use of fuzzy words has its special irreplaceable role. Since fuzziness exists objectively in legal language, the legal translation as a bridge of legal communication must not be translated. The research on the fuzziness of legal language in the past mainly focuses on Legal English and studies the fuzziness of legal English and its translation from the angle of English to Chinese. On the contrary, this article mainly analyzes the vagueness in Chinese legal language, including laws and regulations and judicial language, and so on. There are four chapters in this paper. The first chapter has four chapters. The first chapter briefly introduces the theory of fuzzy linguistics; the second chapter analyses the law. The third chapter analyzes the positive and negative effects of the fuzziness of legal language; the fourth chapter discusses Nida's functional equivalence translation theory and the translation of the fuzzy legal language under the guidance of the theory; finally, it summarizes the paper.
