从“述听”到“视听”：媒介变革对我国法律文化的影响

【摘要】： 媒介变革深刻地影响着法律文化的发展。本文意在通过分析媒介变革与法律文化发展之间的内在关联,揭示各种媒介形态对法律文化不同内容所产生的不同影响,阐释媒介发展对法律文化发展的作用和意义。媒介变革经历了以下过程:从文字出现前的“述听”型传播发展到书面文字传播,再过渡到以图片、电视、电影与互联网为媒介的“视听”型传播,最后实现了以现场直播、实况转播与监视技术为代表的“纯粹视听”型传播。 “述听”型传播造成了法律语言的随意性和法律文本的传奇性。口语传播结构特征促使法律在开放的“法律论坛”中传播,使司法过程“广场化”呈现。口语传播为法律器物与法律规范的产生提供了条件,法律意识在人们心中初步形成、法律权威得到普遍崇拜。文字传承了法律文化、使法律语言走向专业化与规范化、为法律文学作品的出现奠定基础,为系统法律思维的形成和法律职业化的现象出现创造条件。文字促使庭审模式从抗辩式变成了纠问式,形成围绕书面卷宗文档进行的司法活动机制,使法条律令的产生成为可能,习惯法逐渐演变为成文法。视听传播时代的法律题材影视作品扩展了法律文本文化的内容,媒介技术的发展促成法律文化的大众化和全球化传播。“视听”型传播方式一方面促使建立新闻法律制度,另一方面却因娱乐性强削弱了系统理性的法律思维和对法律文化客观公正的判断。 “纯粹视听”型传播方式能再现事实真相、让人形成客观公正的法律观念。其中现场直播以其客观性和中立性减低媒体对司法的影响,监视技术又进一步完善证据制度,使媒介技术与司法过程革命性融合。媒介技术的每一步发展都意味着法律文化传播效力与范围的扩大。法律语言从随意走向规范和专业,法律文本从单一走向多元、从封闭走向开放和互动,法律文化的呈现方式变得更加丰富;人们初浅的法律意识逐渐积累为系统法律思维和法律思想体系,法律思想文化在不断深化发展;媒介的变革将新的法律行为和法律制度注入法律文化中,使社会从习惯法过渡到成文法,在法律行为内容拓宽的同时,法律制度也得到了扩充与完善;权力格局因媒介变革也产生着深刻的变化,司法权与媒体权从一开始由话语所有者享有,转变为由分别被掌握法律知识和传媒技术的不同机构所分瓜,司法的独立性和媒介的监督权最终得以实现。
[Abstract]:This paper intends to reveal the different effects of various media forms on the development of legal culture by analyzing the inner relationship between media change and the development of legal culture .

The dissemination of oral communication causes the law to spread in the open " legal forum " so as to make the judicial process " square " . The oral communication provides the conditions for the emergence of legal instruments and legal norms , and the legal consciousness is preliminarily formed in people ' s mind , and the legal authority is universally admired .

The text inherits the legal culture , makes the legal language go to the specialization and standardization , lays the foundation for the emergence of the legal literary works , creates the conditions for the formation of the system legal thinking and the phenomenon of legal professionalism .

The audiovisual work expands the content of the legal text culture , the development of the media technology contributes to the popularization of the legal culture and the spread of globalization . The " audio - visual " type of communication promotes the establishment of the news legal system , but on the other hand , it has weakened the legal thinking of the system rationality and the objective and fair judgment of the legal culture .

The " pure audio - visual " mode of communication can reproduce the truth and form an objective and just legal concept , in which the live telecast takes its objectivity and neutrality to reduce the influence of the media on the administration of justice , and the surveillance technology further perfects the evidence system , so that the media technology and the judicial process are revolutionary .

Every step of the media technology means the expansion of the effectiveness and scope of the legal culture communication . The legal language becomes more abundant from the single to plural , from the closed to the opening and the interaction , the legal culture is presented in the continuous deepening of development ; the change of the media brings new legal action and legal system into the law culture , the legal system is expanded and perfected .
