论我国中央与地方立法权限争议的法律解决

【摘要】: 立法权限争议,即立法主体之间由于立法权限所引发的争议,是立法主体在行使立法权时,由于划分立法权限的规范有缺陷或者其他复杂原因,而在同一事项上与另一立法主体的立法权冲突或者重叠而产生的法律争议。在我国,以“从计划经济到市场经济”的经济体制改革为轴承的全面改革,使得地方的“经济人”角色苏醒,并在中央与地方间形成利益博弈,中央与地方立法权限的争议便是这一“经济基础”对“上层建筑”的决定作用的外在表现之一。而我国现行中央与地方立法权限划分也存在着“先天不足”,这一文本上的缺陷也导致了现实中中央与地方立法权限争议的频繁发生。 目前,我国现行宪法、立法法、全国人大组织法、国务院组织法、地方各级人大和地方各级人民政府组织法、民族区域自治法、香港特别行政区基本法、澳门特别行政区基本法、《规章制定程序条例》、《法规规章备案条例》以及地方人大有关备案审查的实施细则等一系列法律规范已经对我国中央与地方立法权限争议的解决进行了规定。然而,由于解决我国中央与地方立法权限争议的立法审查制度及“准司法审查”制度的种种缺憾或者局限,我国的中央与地方立法权限争议并不能得到有效的解决,成为困扰我国的一大宪政难题。 为克服我国现行中央与地方立法权限争议解决制度的不足,必须在坚持法治原则、司法最终救济原则的基础之上,改进我国现行的解决中央与地方立法权限争议的立法审查制度,升级我国现行的解决中央与地方立法权限争议的“准司法审查”制度,以全面实现我国中央与地方立法权限争议解决制度的优化升级;并明确、合理划分我国中央与地方的立法权限,以笃力达到我国中央与地方立法权限争议的“标本兼治”。
[Abstract]:The dispute of legislative authority, that is, the dispute between legislative subjects caused by legislative competence, is due to the defects or other complicated reasons of the division of legislative authority when the legislative subject exercises its legislative power. In the same matter and the legislative power of another legislative body conflict or overlap arising from the legal dispute. In China, the overall reform of the economic system from planned economy to market economy has brought the local "economic man" role to life and formed a game of interests between the central and local governments. The controversy between the central and local legislative authority is one of the external manifestations of the decision of the economic basis on the superstructure. However, the division of the legislative authority between the central and local authorities in our country also has a "natural deficiency", which also leads to the frequent disputes between the central and local legislative powers in reality. At present, the current constitution, legislative law, and legislation law of our country have also resulted in frequent disputes over the legislative authority of the central and local authorities. The Organic Law of the National people's Congress, the Organic Law of the State Council, the Organic Law of Local people's congresses and Local people's governments, the Law on Regional National Autonomy, the basic Law of the HKSAR, A series of laws and regulations, such as the basic Law of the Macao Special Administrative region, the regulations on the procedure for making regulations, the regulations on the record of laws and regulations, and the detailed rules for the implementation of the local people's congresses on filing and examination, have already disputed the legislative competence of the central and local authorities of The settlement was defined. However, due to the defects or limitations of the legislative review system and the quasi-judicial review system, the disputes between the central and local legislative authority can not be effectively resolved. In order to overcome the shortcomings of the current central and local legislative authority dispute settlement system, we must adhere to the principle of the rule of law and the principle of judicial ultimate relief. To improve the current legislative review system for resolving the disputes between the central and local legislatures, and to upgrade the current "quasi-judicial review" system for resolving the disputes between the central and local legislatures. In order to realize the optimization and upgrading of the dispute settlement system of the central and local legislative authority in China, it is clear and reasonable to divide the legislative authority between the central and local authorities of our country, so as to achieve the goal of "treating both the root and the root" of the dispute between the central and local legislative authority in our country.
