中美网络著作权合理使用制度比较研究

【摘要】： 合理使用制度一直是版权法中一个容易引起争议而又难以判定的规则，网络的出现使合理使用制度变得更加深不可测。虽然我国现行著作权法对合理使用制度已经有明文规定，但是网络环境对该制度无论是在我国的立法上还是司法实践中都提出了重大的挑战，并且我国的学术界对传统的合理使用制度的研究极鲜有权威性成果，在网络环境中的合理使用制度的探讨更是在摸索中。然而，由于网络在美国出现比我国早得多，美国对网络著作权中的合理使用制度无论是在立法上还是学界的研究都比我国先跨了一大步。因此，，本文从多个方位详尽地阐述美国的网络著作权的合理使用制度，同时，对我国的合理使用制度进行了剖析，通过相比较，从美国的网络著作权合理使用制度中获得启发，进而借鉴其精华。首先，文章开篇即对中美的网络著作权合理使用制度在学术界的研究概况进行综述。接着，对中美网络著作权合理使用制度的历史沿革以及在国际条约中的规定作了的概述，这样为下文分析论述合理使用制度奠定基础。再接着，本文从网络著作权合理使用制度的法律价值目标、文化基础、经济学基础及具体规定的角度论述了网络著作权合理使用制度的共同点；从合理使用制度的内涵、“使用的目的和特征”要求、“对被使用作品的性质”的规定、对未发表作品的规定、“对被使用作品的潜在市场与价值的影响”的规定多维的角度分析比较中美网络著作权合理使用制度的不同之处。可以看出，我国的网络著作权的合理使用制度的发展似乎还是一个刚学走路的幼儿，而美国的网络著作权合理使用制度已经发育为一个少年。随着数字化技术网络的冲击，我国的著作权合理使用制度应该以我国的实际情况为基础，不断地吸取其他国家的成功经验，以促进我国立法发展与完善。鉴于此，本文在最后根据美国的经验，总结了一些启发以及可为我国借鉴之处，以期我国网络著作权的合理使用制度日臻完善。
[Abstract]:The reasonable use system is always a controversial and difficult rule in copyright law, and the emergence of the network makes the reasonable use system more inscrutable. Although the current copyright law of our country already has the explicit stipulation to the reasonable use system, but the network environment has put forward the great challenge to this system not only in the legislation of our country but also in the judicial practice. And the academic circles of our country have very few authoritative achievements on the traditional rational use system, and the discussion of the reasonable use system in the network environment is even more in the exploration. However, due to the emergence of the network in the United States much earlier than China, the United States on the fair use of network copyright system, whether in legislation or academic research has taken a big step ahead of our country. Therefore, this paper elaborates the reasonable use system of American network copyright from many aspects, at the same time, analyzes the reasonable use system of our country, through the comparison, obtains the inspiration from the American network copyright reasonable use system. Then draw lessons from its essence. First of all, the article begins with a summary of the research on the fair use of network copyright in China and the United States. Then, the history and evolution of the fair use system of network copyright between China and the United States and the provisions in international treaties are summarized, which lays a foundation for the following analysis and discussion of the reasonable use system. Then, this paper discusses the common points of the reasonable use system of network copyright from the point of view of the legal value goal, cultural foundation, economic foundation and specific regulation of the fair use system of network copyright, and the connotation of the reasonable use system. "the purpose and characteristics of use", "the nature of the work to be used", and "unpublished work", The provisions of "the influence on the potential Market and value of used works" analyze and compare the differences between China and the United States in the rational use of Internet copyright from a multi-dimensional perspective. It can be seen that the development of the fair use system of network copyright in our country seems to be a toddler, while the fair use system of network copyright in the United States has developed into a teenager. With the impact of the digital technology network, the fair use of copyright system in China should be based on the actual situation of our country, constantly absorb the successful experience of other countries, in order to promote the development and improvement of our legislation. In view of this, in the end, according to the experience of the United States, this paper summarizes some enlightenment and can be used for reference for our country, in the hope that the reasonable use system of network copyright in our country can be perfected day by day.
