“三典”理论视野下中国古代“五刑”的考证

【摘要】：基于执法缘情的思想,早在西周时期古人就提出了"三典刑三国"的原则,即"三典"理论。在"三典"理论的影响下,中国各朝代的"五刑"轻重有所差异,分析其间的差异,浅探治世之成败,略有所见,或可有益于当今学术界之研究。
[Abstract]:Based on the thought of law enforcement, as early as the Western Zhou Dynasty, the ancients put forward the principle of "three codes and punishment three countries", that is, the theory of "three codes". Under the influence of the theory of "three codes", there are differences in the severity of "five penalties" in different dynasties in China. By analyzing the differences between them, the author makes a brief exploration of the success or failure of governing the world, which may be beneficial to the research in the academic circles.
