道德与权利的博弈——美国科姆斯托克法的出台、实施和所引发的社会政治斗争

【摘要】：19世纪后期,保守人士安东尼·科姆斯托克利用当时的政治环境、社会变迁和道德话语,成功游说美国国会通过严苛的反淫秽法,并向各州推广。这项立法,在有效禁止淫秽文学交易的同时,也以维护传统道德的名义侵害个人自由,特别是将避孕节育信息视为"淫秽"内容,压制提倡节育的社会运动,引起了广泛的社会政治斗争。自由爱运动和节育运动,呼吁女性身体自主的权利,公然违反科姆斯托克法,宣传节育知识和女性平等,并展开立法与司法活动,试图修订或废除科姆斯托克法。最终,在社会道德观念变迁、权利话语兴起之后,获得成功。
[Abstract]:In the late nineteenth Century, Anthony, a conservative, used the political environment, social change and moral discourse to lobby the American Congress through the harsh anti obscenity law and popularize it to the States. This legislation, while effectively prohibiting obscene literature transactions, also infringes on individual freedom in the name of traditional morality, especially in the name of traditional morality. Taking contraception information as "obscene" content, suppressing the social movement to promote birth control, causing extensive social and political struggles, free love movement and birth control, appealing to women's right to self-reliance, blatantly violating the law of the amidst, publicizing the knowledge of birth control and women's peace, and conducting legislative and judicial activities to try to amend or abolish the section. In the end, after the rise of social morality and the rise of the right discourse, success was achieved.
