【摘要】： 长期以来,我国立法机关重视法规的制定,但却对法规出台后的实效问题关注不够。随着法规的不断增多,新旧法规之间、不同部门制定的法规之间,经常出现摩擦和冲突。这些相互矛盾的法规给现实生活带来了很多困扰,削弱了法律的权威。可喜的是,近年来,我国立法主体积极探索各种方式和途径提高立法质量,地方立法评估制度就是其中之一。地方立法评估是立法过程中的重要一环,它作为一门应用性很强的技术手段,通过对立法实施效果的评估来提高立法质量,支持理性的立法决策;它是我国立法主体科学立法的一种重要尝试。但遗憾的是,在我国对法规进行系统的评估至今还是一个法律空白,《立法法》并没有相应的规定,致使各地在评估内容、方法、程序等方面存在很大的差异,这将有损于评估报告的科学性和权威性。如何更好地完善地方立法评估制度成为一个亟待解决的问题。目前,我国法学界对地方立法评估制度的研究尚处于起步阶段,实践探索和理论研究的空白使得法学界尤其是立法学界,对此制度的研究价值有普遍的认同。本文以地方立法评估制度的概念、功能和必要性为写作起点,重点研究了地方立法评估标准与程序设计在我国的科学构建。引言简要介绍了目前各地开展地方立法评估工作的一些情况,并对研究地方立法评估的必要性作了阐述,明确了全文将要探讨的问题的主旨和思路。本文除引言和结语外,共分为四大部分。第一章地方立法评估概述。界定了地方立法评估的概念和功能,揭示了地方立法评估的必要性,力图在总体上形成对地方立法评估制度的正确认识。第二章地方立法评估标准的意义和基本要求。本章分为两部分,第一部分论述了确立地方立法评估标准的意义;第二部分论述了构建地方立法评估标准的基本要求。第三章地方立法评估标准体系之构建。这一章主要论述了地方立法评估的七个标准,它们分别是正义性标准、合法性标准、科学性标准、实效性标准、地方特色标准、可操作性标准和技术性标准。第四章地方立法评估程序设计。这一章主要论述了地方立法评估程序的价值、地方立法评估程序设计的基本原则和地方立法评估的程序设计。
[Abstract]:For a long time, the legislatures in our country have attached great importance to the formulation of laws and regulations, but they have not paid enough attention to the actual effect of the laws. With the increasing of laws and regulations, friction and conflict often occur between new and old laws and regulations made by different departments. These contradictory laws and regulations have brought many troubles to the real life and weakened the authority of the law. It is gratifying that in recent years, the main body of legislation in our country has actively explored various ways and means to improve the quality of legislation, among which the local legislative evaluation system is one of them. The evaluation of local legislation is an important part in the process of legislation. As a technical means with strong application, it can improve the quality of legislation and support rational legislative decisions through the evaluation of the effect of legislative implementation. It is an important attempt of scientific legislation of the main body of legislation in our country. However, unfortunately, the systematic evaluation of laws and regulations in our country is still a legal blank, and there is no corresponding provision in the Legislative Law, resulting in great differences in the contents, methods, procedures, etc. This will undermine the scientific nature and authority of the evaluation report. How to improve the local legislation evaluation system is an urgent problem to be solved. At present, the research on the local legislative evaluation system is still in its infancy in the field of law in our country. The gap of practice exploration and theoretical research makes the legal circles, especially the legislative circle, generally agree with the research value of this system. Based on the concept, function and necessity of the local legislative evaluation system, this paper focuses on the scientific construction of the local legislative evaluation standard and program design in China. The introduction briefly introduces some situations of local legislative evaluation in various places at present, expounds the necessity of studying the evaluation of local legislation, and clarifies the gist and train of thought of the problems to be discussed in this paper. In addition to the introduction and conclusion, this paper is divided into four parts. The first chapter is an overview of the evaluation of local legislation. This paper defines the concept and function of the local legislative evaluation, reveals the necessity of the local legislative evaluation, and tries to form a correct understanding of the local legislative evaluation system as a whole. The second chapter is the significance and basic requirements of the evaluation standard of local legislation. This chapter is divided into two parts: the first part discusses the significance of establishing the evaluation standard of local legislation, the second part discusses the basic requirements of constructing the evaluation standard of local legislation. The third chapter is the construction of the standard system of local legislation evaluation. This chapter mainly discusses the seven standards of local legislative evaluation, which are justice standard, legitimacy standard, scientific standard, actual effect standard, local characteristic standard, operable standard and technical standard. The fourth chapter is the design of the evaluation procedure of local legislation. This chapter mainly discusses the value of the local legislative evaluation procedure, the basic principles of the local legislative evaluation procedure design and the local legislative evaluation procedure design.
