论法律全球化过程中的挑战与应对

【摘要】： 法律全球化自古就是人类追求的美好理想,也体现为人类的社会实践运动。在漫长的人类历史中,曾多次出现过法律全球化的雏形。尽管学界有关法律全球化的界定仍莫衷一是,关于法律全球化的理论探讨仍众说纷纭,然不能否认,当今世界,在共同的人性、伦理认知和利益需求基础上,随着经济和政治全球化的迅猛发展,法律全球化确实呈现出愈加强劲的趋向。各国国内法内容的趋同和相互认可、国际法内容的普遍化以及国内法、国际法精神的一致化,特别是欧盟这种超国家组织和法律的形式,是这种趋向的存在形态。故而,对于处于这一强劲趋势之下的我们说来,如何审慎从容应对法律全球化所带来的发生在文化、国家主权和弱势利益保护等层面的严峻挑战,是一个同样严峻的法学课题。
[Abstract]:Since ancient times, legal globalization has been a beautiful ideal pursued by human beings, and it is also embodied in the social practice movement of human beings. In the long history of mankind, many times appeared the embryonic form of legal globalization. Although there is still disagreement in the definition of legal globalization in academic circles, there are still divergent views on the theory of legal globalization. However, it cannot be denied that today's world is based on the common human nature, ethical cognition and interest needs. With the rapid development of economic and political globalization, legal globalization is indeed showing an increasingly strong trend. The convergence and mutual recognition of the contents of domestic laws, the universality of the contents of international law and the uniformity of the spirit of international law, especially the form of supranational organization and law such as the European Union, are the existing forms of this trend. Therefore, for us in this strong trend, how to deal with the legal globalization brought about by the serious challenges in the cultural, national sovereignty and the protection of weak interests, is an equally severe legal subject.
