财产权、正当性及多元主义——现代财产权基本理论探析

【摘要】：财产权的正当性总是和法律范式的转换有着密切的相关性,而法律范式的转换往往通过财产权的变化体现出来。财产权的特殊性就在于个体既要和身外之物发生联系,又要顾及到其他个体及社会的存续。在多元主义背景下,如何把握个体与外在物和个体之间及个体与社会间的关系就成为财产权正当性的主题。一方面,在与外在物的关系中,需要发挥个体的特性使其尽可能多的创造物质财富;另一方面,又需要通过社会机制以保证每一个社会成员都能有体面且全面的社会生活。所以,尽管不同的财产权承担不同的社会任务,但是通过综合性判断的模式给不同类型的财产权提供统一的正当性基础却是可能的,也是必要的。
[Abstract]:The legitimacy of property rights is always closely related to the transformation of legal paradigm, which is often reflected by the change of property rights. The particularity of property right lies in the fact that the individual should not only be connected with other things, but also take into account the existence of other individuals and society. Under the background of pluralism, how to grasp the relationship between individual and external objects and individuals and between individuals and society becomes the theme of the legitimacy of property rights. On the one hand, in the relationship with external objects, it is necessary to give play to the characteristics of individuals so that they can create as much material wealth as possible; on the other hand, it is necessary to ensure that every member of society can have a decent and comprehensive social life through social mechanisms. Therefore, although different property rights undertake different social tasks, it is possible and necessary for different types of property rights to provide a unified legitimacy basis through the comprehensive judgment model.
