乾隆朝秋审金刃杀人条例变更辨析

【摘要】：正清代刑法延续汉代以来形成的"五刑之制",即笞、杖、徒、流、死。《大清律例·名例律》中规定":死刑二,绞、斩",下注"内外死罪人犯,除应决不待时外,余俱监固,候秋审、朝审,分别情实、缓决、矜疑,奏请定夺。"[1]55即,清朝死刑分"死刑立决"和"死刑监候",死刑监候又称"斩监候""、绞监候"。对监候犯人的复核便形成了清代固有的"秋谳大典"即秋审(广义秋审包括秋审和朝审)[2]。统治集团秉承儒家"慎行"思想[3]、伦理纲常思想[4]以
[Abstract]:The criminal law of the Qing Dynasty continues the "five-punishment system" which has been formed since the Han Dynasty, that is, caning, staff, apprenticeship, liu, and death.
