美国民事诉讼管辖权探究——兼论对Personal Jurisdiction的翻译

【摘要】：正引言由于我国与美国在国家结构、法院结构上均存在重大差别,导致两国的管辖权制度存在重大差别。我国学术界对美国的管辖权制度的研究相对于其他制度,如发现程序、证据制度而言,差距甚远。原因也许是我国学者觉得美国的管辖权制度对我国的管辖权制度借鉴意义不大。事实并非如此。不仅美国管辖制度中的程序正义思想对于我国管辖权
[Abstract]:It is pointed out that there are significant differences in the court structure between China and the United States, which leads to significant differences in the jurisdiction system between the two countries. Compared with other systems, such as discovery procedure and evidence system, the research on American jurisdiction system in Chinese academic circles is far from that of other institutions. The reason may be that Chinese scholars think that the American jurisdiction system is of little significance to our jurisdiction system. This is not the case.
