法治与市场:培育新型农业经营主体的国际经验及借鉴

【摘要】：市场是激励,法治是保障。因此,世界上主要的发达国家和地区,在培育新型农业经营主体过程中,都将法治和市场理念贯穿于政府建设、政策制定、贯彻落实以及与新型农业经营主体培育相关的各个环节。一是坚持法治立国、有法必依、违法必究,为新型农业经营主体健康发展提供法律制度保障。二是注重打造守法、诚信、高效、廉洁政府,强化政府公共服务职能;同时不断完善市场机制,营造相对宽松、自由、公平的竞争环境,激发社会创新创造活力,增强农业发展动力。三是坚持疏堵结合、综合施策,促进土地规模化经营,防控非农化和非粮化倾向。四是既注重农业教育科技投入,也注重农业教育科技实效。在对其经验、做法和趋势进行梳理归纳的基础上,结合我国实际,从加强法制建设、发挥市场主导激励、明确政府职责、树立"大工业化"思维、构建"大政研"格局、坚持农业教育科技政府投入与产出绩效兼顾、形成中央与地方联动等方面提出建议。

Third, adhere to the combination of prevention and plugging, comprehensive measures to promote large-scale management of land, control and control of non-agricultural and non-grain tendency. Fourth, pay attention to agricultural education science and technology investment, but also pay attention to agricultural education science and technology effectiveness. On the basis of combing and summarizing its experience, practice and trend, combined with the reality of our country, from strengthening the legal system construction, giving play to the market leading incentive, clarifying the government duty, setting up the thinking of "great industrialization", constructing the pattern of "big politics research", The government input and output performance of agricultural education and science and technology should be taken into account, and suggestions should be made on the formation of central and local linkage.
