法律英语文体特征与简明英语运动

【摘要】：众所周知,长久以来,法律与普通民众之间似乎一直存在着一条无法逾越的鸿沟。各种法律法规,条文规章的语言风格常为普通人所无法理解的。当我们的权利利益受到非法侵害的时候,我们亟需拿起法律武器保护自己的切身利益不受损害。因此,法律语言必须是一种简单清晰的语言文字,使每个人都能最大程度的理解并且运用到日常生活中的各种侵权行为中。语言的简明化趋势已势不可挡。法律语言长期以来作为一种晦涩难懂的个体语言更是如此。20世纪70年代以来,西方国家兴起一场规模宏大的简明英语运动。这场运动推动了立法语言的文体风格及措词造句的巨大变化。精确而简明的法律语言有助于提高法律文书的执行效能和效率。在适当的语境下,避繁就简,通过使用简明清晰的语言使行文更加清晰,简练而又具有说服力。本文旨在揭示立法过程中使用简明英语语言的重要意义,就如何提高法律条文可读性这一问题阐述观点,提出初步建议。通过分析法律语言的文体特点,从词汇,句法层面上提出简明英语的使用技巧及方法。本文分为五部分。第一部分简要介绍了本文所要探讨的几个相关概念,包括法律英语及简明法律英语。第二部分介绍了文体及文体学,以及从词汇,句法,篇章三个层面分析了法律语言的文体特点。第三部分主要介绍了”简明英语运动”在世界各地的开展,以及针对简明英语所出现的批评性理论。第四部分主要就词汇,句法两个方面提出建议。最后一部分总结了简明法律英语的发展趋势和研究意义。
[Abstract]:As we all know, there seems to be an insurmountable gulf between law and ordinary people for a long time. The language and style of laws and regulations are often beyond the comprehension of ordinary people. When our rights and interests are unlawfully infringed, we urgently need to take up legal weapons to protect our vital interests from harm. Therefore, the legal language must be a simple and clear language so that everyone can understand and apply it to all kinds of infringing acts in daily life. The trend of language conciseness has become irresistible. The legal language has long been a kind of obscure individual language. Since the 1970s, a large-scale and concise English movement has emerged in western countries. This movement promoted a great change in the stylistic style and wording of legislative language. Precise and concise legal language helps to improve the effectiveness and efficiency of the enforcement of legal instruments. In the appropriate context, avoid the complexity of simple, through the use of concise and clear language to make the text clearer, concise and persuasive. The purpose of this paper is to reveal the significance of the use of concise English language in the legislative process and to put forward some preliminary suggestions on how to improve the readability of legal texts. By analyzing the stylistic features of legal language, this paper puts forward the techniques and methods of using concise English from the lexical and syntactic levels. This paper is divided into five parts. The first part briefly introduces several related concepts, including legal English and concise legal English. The second part introduces the stylistics and stylistics, and analyzes the stylistic features of the legal language from the lexical, syntactic and textual levels. The third part mainly introduces the development of Concise English Movement around the world and the critical theory of Concise English. The fourth part mainly puts forward suggestions on lexical and syntactic aspects. The last part summarizes the development trend and research significance of concise legal English.
