中、美、德三国法学专业教材比较研究

【摘要】:我国高校法学专业核心课程教材在形式上、内容上都存在着突出问题,美国德国法学专业教材具有其突出的特点,中美德三国法学专业教材在出版组织者、编写者、结构体系、在教学中的作用及写作风格等方面都存在较大差异。文章认为,我国的法学专业核心课程教材建设要取长补短,促进法学专业核心课程教材的转变,即由统编主导向市场主导的转变、由主编式向独著式、合著式的转变、从法条解释向理论诠释、案例剖析的转变、从教学上的"本本"到参考资料的转变、从形式上的单一性到形式多样性的转变。
[Abstract]:There are outstanding problems in the form and content of the core curriculum of law major in Chinese universities and colleges, the American and German textbooks of law major have their outstanding characteristics, and the publishing organizers, compilers, and structural systems of the textbooks of law major in China and Germany. There are great differences in teaching function and writing style. The article holds that the construction of the core curriculum teaching materials of law major in our country should learn from each other and promote the transformation of the teaching materials of the core curriculum of law major, that is, the transformation from the overall editing to the market leading, from the editor-in-chief to the one-man and co-authorship. From the interpretation of law to the interpretation of theory, the transformation of case analysis, from the teaching of the "book" to the transformation of reference materials, from the unity of form to the transformation of diversity of form.
