俄联邦民法典现代化之路

【摘要】：当前在俄罗斯全面现代化背景下,民法典完善与发展再次成为其国内立法的重点与讨论的中心。及时反映和有效调整转型后期社会经济现实、为国家全面现代化提供立法支撑和加速融入全球经济一体化、推进与欧盟一体化成为民法典现代化的内部驱动力与外部激励。民法典现代化具体表现为在遵循现行私法理念与既有框架下,涵盖基本原则与具体规则的整体大规模改进与优化。民事立法机制权威的顶层设计、注重专家的立法作用成为俄罗斯民法典现代化高效、顺利推进的重要保障。
[Abstract]:At present, under the background of Russia's comprehensive modernization, the perfection and development of civil code has once again become the focal point and the center of discussion of its domestic legislation. It reflects and effectively adjusts the social and economic reality in the later period of transition, provides legislative support for the overall modernization of the country and accelerates its integration into the global economic integration, and promotes the integration with the European Union as the internal driving force and external incentive for the modernization of the civil code. The modernization of civil code is embodied in the overall improvement and optimization of basic principles and specific rules under the existing framework of private law. The top-level design of the authority of the civil legislation mechanism and the emphasis on the legislative role of the experts have become an important guarantee for the modernization and smooth advancement of the Russian Civil Code.
