美国宪法中反腐败思想研究

腐败是历代人民所面临的一个棘手问题。它为人类文明埋下了潜在的危机，是各种社会形态发展的障碍：它扭曲竞争，破坏民主，损害国家荣誉。它使公仆形象和公共利益蒙羞。和贩奴这样的罪恶不同，腐败更难清除。 在人类漫长的历史中，人民和政府从没停止过和腐败的斗争。深知腐败之危害的美国人民极其重视在意识形态上保持警惕，并通过立法改革和特殊应对措施来进行监督。然而，像美国这样的宪政国家，反腐举措的重点在于最高法律：宪法。 本篇论文以美国宪法文本为研究对象，探究蕴涵其中的反腐思想，以加深对美国宪法以及其中的反腐败思想的理解，为我国反腐败提供有益借鉴。 由于不同学者的理解不同，腐败的定义长期以来存在着争议。海登海默总结了当代社会学家所提出的定义，将其分为三类，分别强调公共职位、市场因素和公共利益。本篇论文将采用这一观点，并将重点放在政治腐败上，不是从经济或道德的角度，而是从政治角度分析美国宪法中的反腐思想。 论文分析了腐败的三种根源：权利、经济和心理。并总结了腐败的三个固有特征：波动性发展、多样性和顽固性。从历史的角度对美国政治腐败和反腐败的努力进行回顾，以期对美国反腐败传统更进一步理...
