我国基层法院巡回审判制度研究

【摘要】：巡回审判作为人民法院方便人民群众诉讼的一种审判方式，从建立至今，一直发挥着其自身独特的优势与价值。但是，伴随着社会的不断发展，当前我国的巡回审判制度，无论是在立法层面还是具体实践中，都存在诸多问题，主要表现在立法方面缺乏实际操作性，相关保障制度缺失，，审判活动过于随意，与基层司法组织缺乏沟通，结案时过分追求调解的方式。究其原因，主要在于传统法律观念与现代司法制度的冲突，法官素质的差异及外在环境的影响。为完善我国基层法院的巡回审判制度，必须进一步完善相关制度以规范实践操作，落实经费保障与庭审安全，明确法官权责并对其多方监督，搭建与基层组织的长效沟通机制，坚持调解优先与诉调对接相结合。
[Abstract]:A trial of assizes as the people's court to facilitate litigation of people, from establishment to now, has been playing its own unique advantages and value. However, with the continuous development of society, China's current assizes, either in legislation or in practice, there are many problems, mainly lack of practical operation in the aspect of legislation, the lack of relevant security system, judicial activities is too arbitrary, lack of communication with the grassroots judicial organization, at the close of excessive pursuit of mediation. The reason mainly lies in the conflict between the traditional legal concepts and modern judicial system, judges and differences in the impact of the external environment. In order to improve the basic level in China the court of assizes, to further improve the relevant system to regulate the practice operation, the implementation of the funding guarantee and safety trial, the judge and the responsibilities of supervision, Build a long-term communication mechanism with grass-roots organizations, and adhere to the combination of mediation priority and litigation and docking.
