加州法官管理规则借评

【摘要】:近年来我国民众对法院裁判的信任度是越来越低,这与对法官的公正性和中立性的质疑不无关系。司法实践中,,实施与其法官身份的中立性和公正性不相符的法官不在少数,如接受当事人及其律师的宴请等等。产生上述情况的原因可能是多方面的,其中一个重要的原因就是对法官行为进行规制的法律制度不完善。 本文以加州法官管理规则借评为题,分四个部分进行论述。第一部分为加州法官管理规则的立法沿革,对加州法官管理规则的立法沿革及其立法理由进行了论述。第二部分是对加州法官行为规则的具体内容进行描述。主要涉及对法官的职务活动、政治活动、金融活动、其他的司法外活动以及法官回避问题的规范,其对法官的规制涉及法官行为的方方面面,呈现出系统化的特征。第三部分的主要是对加州法官不端行为的处理机制进行介绍。其中讲述了法官不端行为的处理机构及信息来源、法官不端行为的处理程序、救济程序、信息的保密及公开五个方面的内容。第四部分的主要内容是加州法官管理规则对我国的借鉴意义。文章中对我国的相关法律规定的现状及其不足进行了分析。该部分总的来说分为两部分,即加州法官行为规则对我国的借鉴意义(实体性部分)和加州法官不端行为处理机制对我国的借鉴意义(程序性部分)。在加州法官行为规制对我国的借鉴意义部分,文章中指出我国的相关规定存在相关法律的分散性和重复性、对法官业务外活动进行规制的立法不合理、对法官行政性职责缺乏规制以及对法官的家庭成员的规制不合理四个方面的缺陷,并对这四个方面的完善提出了一些建议;在加州法官不端行为处理机制对我国的借鉴意义部分,文章中指出我国现行的法官不端行为处理机制存在处理部门的非中立性、证明标准不明确、救济程序行政化等不足之处,并相应的提出了解决方案。
[Abstract]:In recent years, our people's trust in court decisions is getting lower and lower, which has something to do with the impartiality and neutrality of judges. Judicial practice. There are not a few judges who are not in line with the neutrality and impartiality of their judges, such as accepting banquets from their clients and their lawyers, etc. The reasons for the above may be manifold. One of the important reasons is that the legal system of regulating the behavior of judges is not perfect. This article takes the California judge management rule as the title, divides into four parts to carry on the discussion. The first part is the California judge management rule legislative evolution. The second part is to describe the specific content of California judges' rules of conduct. It mainly involves the judges' official activities and political activities. The regulation of financial activities, other extra-judicial activities and the question of judges' recusal involves all aspects of judges' behavior. The third part mainly introduces the handling mechanism of California judge misconduct. It describes the processing mechanism and information source of the judge misconduct. The procedure for handling misconduct by a judge. The main content of part 4th is the reference meaning of California judge management rules to our country. The article analyzes the current situation and deficiency of the relevant laws and regulations in our country. The part is generally divided into two parts. That is, the reference meaning of California judge behavior rule to our country (substantive part) and the reference meaning of California judge misconduct handling mechanism to our country (procedural part); Part of the reference meaning of the behavior regulation of judges in California to our country. The article points out that the relevant provisions of our country have the dispersion and repeatability of the relevant laws, and the legislation to regulate the outside activities of judges is unreasonable. Lack of regulation of judges' administrative duties and unreasonable regulation of judges' family members, and some suggestions on the perfection of these four aspects are put forward. In the part of the reference meaning of California judge misconduct handling mechanism, the article points out that the existing judge misconduct handling mechanism in our country has the non-neutrality of the processing department, and the standard of proof is not clear. The administration of relief procedures and other deficiencies, and the corresponding solutions.
