社会转型期人民调解制度的变迁与路径探析

【摘要】：曾被西方学者誉为“东方经验”的人民调解制度,是中国特色民主主义法制建设的伟大创造,也是我国法制现代化进程中当之无愧的本土资源。半个多世纪以来,一直发挥着解决纠纷的作用。然而,20世纪90年代后期以来,由于社会转型所带来的社会结构的变化、价值观念的转变、人们权利意识和法律意识的增强等原因导致了人民调解制度的功能已经逐步弱化。虽然,人民调解制度在社会转型期有着明显的不适应性,解决纠纷的能力下降,但中国的法治之路必须重视我国的本土资源。因此,在总结社会转型期人民调解制度发生变化的根本原因基础上,对完善人民调解制度提出具体设计,以探寻适合现代人民调解制度的发展途径。本文正文分为三个部分: 第一章:社会转型期人民调解制度的变迁,概括了人民调解制度在社会转型期发生了哪些方面的变迁以及产生变迁的原因; 第二章:我国人民调解制度对ADR模式的借鉴,概括了我国不同历史时期的调解制度、现行非诉讼纠纷解决机制对人民调解制度的启迪,以及我国人民调解制度对ADR模式的借鉴意义; 第三章:人民调解制度的现代建构,概括了人民调解制度的局限性及完善人民调解制度的现实意义,并对完善人民调解制度提出了具体措施。同时,结合我国城市与农村对法治需求的差异,进一步提出了人民调解制度在城市与农村的发展构想。
[Abstract]:The people's mediation system, once praised by western scholars as "Oriental experience", is a great creation of the construction of democratic legal system with Chinese characteristics, and a well-deserved local resource in the process of legal modernization in our country. However, since the late 90s of the 20th century, due to the changes in social structure and values brought about by social transformation, The function of the people's mediation system has been gradually weakened due to the strengthening of people's right consciousness and legal consciousness. Although, the people's mediation system has obvious inadaptability in the period of social transformation, and the ability to resolve disputes has declined. However, the road to rule of law in China must attach importance to the local resources of our country. Therefore, on the basis of summing up the fundamental causes of the changes in the people's mediation system in the period of social transformation, this paper puts forward a concrete design to perfect the people's mediation system. In order to explore the development of modern people's mediation system, the text is divided into three parts:. The first chapter: the change of the people's mediation system in the social transition period, which aspects of the people's mediation system changes in the social transition period and the reasons for the changes; The second chapter: the reference of the people's mediation system to the ADR model, summarizes the mediation system in different historical periods of our country, and the enlightenment of the current non-litigation dispute settlement mechanism to the people's mediation system. And the reference meaning of Chinese people's mediation system to ADR model; Chapter III: the modern construction of the people's mediation system, summarized the limitations of the people's mediation system and the practical significance of perfecting the people's mediation system, and put forward specific measures to improve the people's mediation system. Based on the difference between urban and rural areas, this paper puts forward the idea of the development of people's mediation system in urban and rural areas.
