关于邓玉娇案审判的思考

【摘要】：随着现代社会转型和经济不断发展,社会矛盾变得复杂多样,各种冲突事件越来越多。2009年发生的邓玉娇案由于其所涉及到的民众与公权力的对立矛盾而备受关注,加之网络媒体的广泛传播,引起强烈民愤,成为典型的社会事件之一。该事件不仅冲击社会道德底线,而且给司法审判带来了难题。本文以邓玉娇案审判、判决理由和结果为出发点,分析案件审判中出现的诸如社会舆论与法院审判的关系、刑法的适用、精神病司法鉴定的适用等问题。运用案例分析法,结合本人所学的相关理论知识,对上述问题进行分析论证,提出一些自己的建议和改进措施,以便对我国法律制度的完善和司法实践的顺利进行有所助益。本文除引言和结语外,由以下三个部分构成：首先,介绍了本案的基本案情、处理过程和判决结果,提出由本案审判所引发的问题,诸如新闻媒体报道与司法判决的关系问题、审判和判决结果中刑法适用问题、精神病司法鉴定的适用问题等。本案从案发到法院作出判决整个阶段,始终处在媒体报道之下。报道初期,新闻报道只是正常的报道案件进展情况。随着案件的深入报道,新闻媒体掺杂了自身的主观性思想,甚至出现了主观性推测案件判决的情形,引发了强烈的支持邓玉娇的舆论,使得审判机关在审判过程中利用精神病鉴定手段做出了罪行不一致的判决,存在刑法适用问题。其次,运用刑法理论与案例相结合的方法,针对案件审判出现的问题进行原因分析,提出：第一,相关法规缺失或不合理。我国缺乏专门的新闻法、精神病司法鉴定法来规范新闻报道和精神病鉴定,刑事法律的量刑幅度过宽,使得法官的自由裁量权过大,容易出现罪行不相适应的现象；第二,司法独立审判功能弱化。司法审判受行政、舆论、人情关系、法官素质不过硬的影响,不能独立审判,进而不能更好的实现司法公正和保障人权；第三,舆论监督作用偏失。媒体一味追求轰动效应、主观化倾向严重、记者素质差,不能更好的行使监督权；第四,精神病司法鉴定程序的缺陷。鉴定启动权规定绝对化、鉴定机关的规定不完备、鉴定者不是非常专业,这导致审判中司法鉴定不能维护当事人的合法利益。最后,在分析原因的基础上,提出解决的方法和途径。第一,尽快出台新闻法,规范新闻报道和舆论监督权；第二,将已实行的量刑建议尽快写入刑法文本,规制法官自由裁量权；第三,改革行政体制,加强与媒体的沟通,提高法官的业务素质和职业道德,强化司法独立审判功能；第四,制定专门的法律法规来规范精神病司法鉴定的程序,严格司法审判中精神病鉴定适用。从而保障司法公正的实现,达到法律效果和社会效果的统一
[Abstract]:With the transformation of modern society and the continuous development of economy, social contradictions become more and more complicated and various conflicts are more and more frequent. The case of Deng Yujiao, which took place in 2009, attracted much attention because of the contradiction between the public and the public power involved in the case. In addition, the widespread dissemination of network media has aroused strong public indignation and become one of the typical social events. This incident not only impacts on the bottom line of social morality, but also brings difficulties to the judicial trial. Starting with the reason and result of judgment, this paper analyzes the relationship between public opinion and court trial, the application of criminal law, the application of forensic expertise and so on. Combining with the relevant theoretical knowledge I have learned, this paper analyzes and demonstrates the above problems, and puts forward some suggestions and measures to improve the legal system and judicial practice of our country. In addition to the introduction and conclusion, this article consists of the following three parts: firstly, it introduces the basic facts of the case, the process of handling the case and the result of the judgment, and puts forward the problems caused by the trial in this case. Such as the relationship between news media reports and judicial decisions, the application of criminal law in trials and decisions, the application of psychiatric expertise, etc. Always under media coverage. At the beginning of the report, the news report was only a normal way to report the progress of the case. As the case went further, the news media mixed its own subjective thinking. There was even subjective speculation about the judgment of the case, which aroused strong public opinion in support of Deng Yujiao, and made the judicial organs make use of psychiatric expertise in the course of the trial to make inconsistent judgments on crimes. Secondly, by using the method of combining criminal law theory with cases, the causes of the problems in the trial of cases are analyzed, and the following points are put forward: first, the relevant laws and regulations are lacking or unreasonable, and there is no special press law in our country. The law of forensic identification of mental illness regulates news reports and psychiatric identification, and the range of sentencing in criminal law is too wide, which makes the discretion of judges too large, and it is easy to appear the phenomenon that crimes do not suit each other; second, The function of independent judicial trial is weakened. Judicial trial is influenced by administration, public opinion, human relations, judges' quality, and can't be judged independently, and then it can't better realize judicial justice and protect human rights. Third, The media blindly pursue sensational effect, the subjective tendency is serious, the quality of the reporter is poor, and the supervision power can not be exercised better. 4th, the defects of the procedure of forensic appraisal of mental illness. The regulation of the right to initiate the appraisal is absolute. The provisions of the appraisal organ are not complete, and the appraiser is not very professional, which leads to the fact that the judicial appraisal cannot safeguard the legitimate interests of the parties in the trial. Finally, on the basis of analyzing the reasons, the author puts forward the methods and ways to solve the problem. First, The press law should be issued as soon as possible to standardize the power of news reporting and supervision by public opinion; second, the already implemented recommendations on sentencing should be written into the text of the criminal law as soon as possible to regulate the discretion of judges; third, to reform the administrative system and strengthen communication with the media. Improve the professional quality and professional ethics of judges, strengthen the function of independent judicial adjudication; 4th, formulate special laws and regulations to standardize the procedures of forensic psychiatric expertise, Strict application of psychiatric examination in judicial adjudication, thus ensuring the realization of judicial justice and achieving the unity of legal and social effects
