论我国人民调解制度的完善

【摘要】：随着市场经济的发展和社会利益格局的不断调整,当今我国的社会矛盾纠纷有了新的表现。根据当前我国社会纠纷的特点,研究一套适合现今实际情况的纠纷解决机制,是促进社会稳定和和谐社会发展的必然要求。本文即是从我国人民调解制度有关规定出发,结合实践中纠纷解决机制,提出应加强人民调解在大调解工作体系中的基础性作用,并对目前人民调解制度存在的不足进行了思考与分析,进而就如何完善我国人民调解制度提出了相应的对策。本文由引言、正文、结语三部分组成,正文包括四个部分,分别为“大调解体系”的人民调解,完善人民调解制度的必要性分析,我国人民调解制度的规定及缺陷和完善人民调解法律制度的对策。第一部分,首先介绍了目前我国民间纠纷解决的主要方式,即人民调解、司法调解和行政调解,然后从人民调解组织网络、人民调解员等方面对人民调解解决机制的现状进行了描述。第二部分,先是分析了社会矛盾纠纷发展的新形势和人民调解工作的优点,以及“大调解体系”中人民调解的基础性地位,得出完善人民调解法律制度的必要性。第三部分,首先介绍了人民调解的相关法律、规章和制度,再根据实践中出现的问题,对目前人民调解制度的缺陷进行了分析研究,找到制约人民调解作用发挥的制度原因。第四部分,从解决人民调解制度执行中的实际问题出发,通过提高调解协议的效力和人民调解的规范化建设等方面,提出完善人民调解制度的对策与建议,以更加有效的发挥人民调解的功能作用。
[Abstract]:With the development of the market economy and the constant adjustment of the social interest pattern, the social contradictions and disputes in our country have new manifestations. According to the characteristics of the current social disputes in our country, we study a set of dispute resolution mechanism suitable for the current actual situation. It is an inevitable requirement to promote social stability and harmonious social development. Based on the relevant provisions of the people's mediation system of our country and the dispute resolution mechanism in practice, this paper puts forward that the basic role of people's mediation in the great mediation work system should be strengthened. This paper also analyzes the shortcomings of the people's mediation system, and puts forward the corresponding countermeasures on how to perfect the people's mediation system in our country. This paper consists of three parts: introduction, text and conclusion. The text consists of four parts, namely "Great Mediation system" of people's Mediation, and the necessity of perfecting people's Mediation system. The regulations and defects of the people's mediation system in China and the countermeasures to perfect the legal system of the people's mediation. The first part first introduces the main ways of resolving civil disputes in our country, that is, people's mediation, judicial mediation and administrative mediation, and then from the network of people's mediation organizations, People mediators and other aspects of the people's mediation settlement mechanism described the current situation. The second part first analyzes the new situation of the development of social contradictions and disputes and the advantages of the people's mediation, and the basic position of the people's mediation in the "Great Mediation system", and concludes the necessity of perfecting the legal system of the people's mediation. The third part first introduces the relevant laws, regulations and systems of people's mediation, and then according to the problems in practice, analyzes and studies the defects of the current people's mediation system, and finds out the system reasons that restrict the people's mediation function. Part 4th, starting from solving the practical problems in the implementation of the people's mediation system, through improving the effectiveness of the mediation agreement and the standardized construction of the people's mediation, puts forward the countermeasures and suggestions to improve the people's mediation system. In order to play a more effective role in the function of people's mediation.
