【摘要】:近年来,在现行大调解机制的背景下,人民调解工作蓬勃发展,人民调解组织不断健全,人民调解员队伍整体素质不断提高,人民调解工作在预防和化解社会矛盾纠纷,促进社会和谐稳定方面越来越发挥着不可替代的重要作用。人民调解作为一项具有中国特有的、具有深厚中华民族传统文化内涵的法律制度,是我国特有的化解矛盾、消除纷争的非诉讼纠纷解决方式,是我国纠纷解决机制中的“第一道防线”,被国际社会誉为“东方经验”、“东方之花”。十一届全国人大常委会于2010年8月28日审议通过的《中华人民共和国人民调解法》,从立法上确立了人民调解制度的法律地位和基本框架,对实践中一直存在争议和难以解决的人民调解性质、调解组织形式、调解员的选择、当事人在调解中的权利义务、调解协议效力等都做出了明确规定,为指导管理人民调解工作,和进一步开展人民调解工作提供了坚实的法律保障,是人民调解制度发展的一座里程碑。 在《人民调解法》刚刚出台的背景下,笔者试图结合该法的相关规定,在阐述人民调解的基本理论和历史渊源的基础上,对人民调解发展的现状和现实困境深入剖析当前人民调解工作存在的问题,并结合对各地人民调解工作创新模式的梳理,提出自己对人民调解制度进一步完善的思路。 在结构安排上,本文共分为五大部分:第一部分是对人民调解制度的基本理论作了阐述,包括人民调解的概念及界定、人民调解组织形式以及人民调解工作的调解范围。第二部分是站在人民调解的历史角度分析,包括对我国传统民间调解的描述、现代人民调解制度的产生和发展。第三部分是从人民调解重新复兴的角度来分析该制度,从社会背景和对其功能定位两方面出发;第四部分分析了我国当前人民调解制度的发展,包括近年来对各地人民调解发展和创新模式的梳理并简单评析《人民调解法》的相关规定,重点将放在人民调解工作发展中存在的问题。最后一部分是为人民调解制度的进一步完善提出了一些自己的思路,包括加强人民调解员队伍建设、提升人民调解协议的效力、扩大人民调解组织的覆盖面和对是否创设“人民调解前置”的见解。
[Abstract]:In recent years, under the background of the existing mediation mechanism, the people's mediation work has flourished, the people's mediation organization has been continuously improved, the overall quality of the people's mediators has been continuously improved, and the people's mediation work is preventing and resolving social contradictions and disputes. Promoting social harmony and stability is playing an irreplaceable and important role. As a legal system with Chinese characteristics and profound connotation of Chinese traditional culture, people's mediation is a unique solution to contradictions in our country. Non-litigation dispute resolution methods to eliminate disputes, It is the "first line of defense" in the dispute resolution mechanism of our country, and is praised by the international community as "the oriental experience" and "the flower of the east". The people's mediation of the people's Republic of china, which was deliberated and adopted by the standing committee of the 11th national people's Congress on August 28th 2010. The law establishes the legal status and basic framework of the people's mediation system. The nature of people's mediation, the form of mediation organization, the choice of mediators, the rights and obligations of the parties in mediation, the validity of mediation agreements and so on, which are always controversial and difficult to resolve in practice, are clearly stipulated. It is a milestone in the development of the people's mediation system, which provides a solid legal guarantee for guiding and managing the people's mediation work and further developing the people's mediation work. Under the background of the people's Mediation Law, the author tries to explain the basic theory and historical origin of the people's mediation on the basis of the relevant provisions of the law. This paper analyzes deeply the problems existing in the current people's mediation in the present situation and the realistic predicament of the people's mediation, combs the innovative modes of the people's mediation work in various places, and puts forward his own ideas for the further improvement of the people's mediation system. In terms of structure arrangement, this paper is divided into five parts: the first part is to elaborate the basic theory of people's mediation system, including the concept and definition of people's mediation. The organizational form of people's mediation and the mediation scope of people's mediation. The second part is an analysis from the historical perspective of people's mediation, including the description of traditional folk mediation in China. The third part is to analyze the modern people's mediation system from the angle of people's mediation revival, starting from the social background and its function orientation. The 4th part analyzes the current development of the people's mediation system in China, including combing the development and innovative modes of people's mediation in recent years and simply commenting on the relevant provisions of the people's Mediation Law. Emphasis will be placed on the problems existing in the development of people's mediation. The last part is to put forward some ideas for the further improvement of the people's mediation system, including strengthening the building of the contingent of people mediators and enhancing the effectiveness of the people's mediation agreement. Expand the coverage of people's mediation organizations and whether to create a "people's mediation front."
