论监察体制改革背景下的监察权与检察权

【摘要】:监察体制改革导致了国家监察委员会的诞生和检察院部分职能的整合,引发了监察权和检察权法律性质的重新定位。以权力制约为基础,监察权是独立于立法权、行政权和司法权的国家权力,属于权力监督的范畴。检察院随着职能整合而被部分剥离的权力主要是职务犯罪侦查权。事实上该项权力的行使本来就不属于权力监督,而属于权力制衡,检察院对审判行为、刑事判决执行机关及监所机关的执行行为以及一般行政行为的监督权才属于真正意义上的监督权。因此,职能整合并不会改变检察机关作为法律监督机关的宪法定位。监察监督和检察监督在对象、范围、方式和阶段四个方面形成差异互补,二者各司其职,丰富和完善了权力制约体系。
[Abstract]:The reform of the supervisory system resulted in the birth of the National Supervisory Committee and the integration of some functions of the Procuratorate, and the reorientation of the legal nature of the supervisory and prosecutorial powers. Based on the restriction of power, the supervisory power is independent of the legislative power. The state power of executive power and judicial power belongs to the scope of power supervision. The power that procuratorates are partially stripped off with the integration of their functions is mainly the power to investigate crimes committed by duty. In fact, the exercise of this power does not belong to power supervision. But it belongs to the checks and balances of power, the procuratorate's right to supervise the judicial acts, the execution of criminal judgment enforcement organs and the organs of the prison institutions, and the general administrative acts. Therefore, the supervisory power of the procuratorates belongs to the real sense. Functional integration will not change the constitutional orientation of procuratorial organs as legal supervisory organs. Supervision and procuratorial supervision are different and complementary in four aspects: object, scope, method and stage. Enriched and perfected the power restriction system.
