婚前财产公证的利与弊

【摘要】：近年来,社会经济发展迅速,人们的物质生活在质量上得到了很大的提高,物质生活的满足造成人们不在热衷于婚姻的稳定度,离婚率居高不下且持续增长,而财产问题一直都离婚案件中的难点问题,特别是关于婚前财产的问题更加复杂,这就引发了人们对于婚前财产问题的加备关注,而婚前财产公证制度这项事前防范措施,就是针对在结婚之前的个人财产与债务这个问题,夫妻双方所形成的协议,并对该协议的真实性与合法性进行证明的一项活动,从最初被人们有所抵制,而到现在越来越多的民众开始予以认可并接受,引起了社会学者和民众的热议。一方面,婚前财产公证制度有利于家庭和睦,相互保护和稳定婚姻,保证财产的良好秩序,能够避免男女双方在婚姻一旦出现问题而会在双方的财产方面发生矛盾,从而有效的推动离婚案件办案的进程,提高办案效率,减少司法成本的运行,可见,在一定意义上该制度是婚姻制度的一次进步,还体现了经济的进步以及思维方式的变化,但是从另一方面,婚前财产公证制度也体现了对配偶的不信任,和道德层面也产生了冲突。婚前财产公证制度有利也有弊,关键在于从何种角度来分析。对此,本文通过分析婚前财产公证制度的基本理论,在研究我国婚前财产公证制度的现状的基础上,探讨婚前财产公证制度的利与弊,从而剖析当前婚前财产公证制度存在的问题,并提出相应的解决建议,以期切实的发挥其在维护家庭稳定,提高司法效率,构建婚姻财产良好的秩序,推动社会文明进步等方面的积极一面,进一步的推动婚前财产公证制度的逐步完善。
[Abstract]:In recent years, the rapid development of economy, people's material life has been greatly improved in terms of quality, material life satisfaction caused by people are not keen on the stability of marriage, the divorce rate is high and sustained growth and property issues have been difficult problems in the case of divorce, especially regarding premarital property more complex problems this, it has sparked the premarital property problem and preparation of attention, and the system of marital property notarization prevention measures is for personal property and the debt before the marriage of this problem, the couple formed an agreement, and the authenticity and legitimacy of the protocol is proved, from the first people has resisted, and now more and more people began to be recognized and accepted by the society, scholars and public hot debate. On the one hand, the premarital property certificate system favorable In family harmony, mutual protection and stable marriage, ensure the good order of property, to avoid both men and women in marriage once problems and contradictions occur on both sides of the property, so as to effectively promote the process of handling the divorce cases, improve work efficiency, reduce the cost of our method of operation, so in a sense of the system is a progress of the marriage system, but also reflects the economic progress and change the way of thinking, but on the other hand, the property notarization system also reflects the distrust of the spouse, and the moral level also had a conflict. The property notarization system has its advantages and disadvantages, the key is to analyze from the perspective of what. In this regard, this article through the analysis of the basic theory of pre marital property notarization system, based on the research status of premarital property notary system in China on the advantages and disadvantages of the pre marital property notarization system, thus The analysis of premarital property notary system, and puts forward corresponding solutions, in order to play their role in maintaining family stability, improve judicial efficiency, construct the marital property in good order, promoting social civilization progress and the positive side, further promote the property notarization system gradually perfect.
