足球协会内部纠纷解决机制研究

【摘要】：随着足球运动社会化、商业化的程度越来越高,足球领域出现了越来越多、越来越复杂的体育纠纷。相较于其他体育领域,足球领域的纠纷解决更依赖于足球协会内部的纠纷解决机制。这一纠纷解决机制是足球纠纷解决最根本和最重要,同时也是被实践证明为最行之有效、最具执行力的纠纷解决机制。因此,本文选取足球协会内部的纠纷解决机制作为研究主题,以期能探寻足球领域纠纷解决的主要制度和运行规律。本文在深入分析足球协会内部纠纷解决机制生发机理的基础上,通过考察国际足联这一世界范围内足球事务最高管理机构的内部纠纷解决制度与实践,以及其他国家国内足球协会的内部纠纷解决机制,并结合我国的足球管理体制,提出了完善我国足球协会内部纠纷解决机制的建议与构想。本文分为引言、正文、结语三个部分。正文部分共分为五章。第一章对论题所涉的基本概念进行了界定和分析。本章首先对协会、足球协会、纠纷、体育纠纷、体育纠纷解决机制的概念、性质、特征分别进行了阐释,其中重点探究了中国足球协会的性质定位。其次,对足球协会内部纠纷解决机制与外部纠纷解决机制的优缺点及相互关系进行了比较和探讨。最后,分析了足球协会内部纠纷解决机制存在的根源,并对足球协会内部纠纷解决机制的各个构成要素：基本原则、主体、客体、程序、法律效力及监督,逐一进行了考察。第二章探寻了足球协会内部纠纷解决机制存在的理论基础。本章从协会与政府关系、协会与会员关系这两个维度,对足球协会乃至其他单项体育协会内部纠纷解决机制存在的理论基础作了分析,指出足球协会内部纠纷解决机制存在的支撑理论有两个：治理理论、社会契约理论。第三章考察了国际足球联合会内部纠纷解决的制度与实践。本章首先对国际足联内部纠纷解决的基本制度按照纠纷解决机制的基本要素(纠纷解决机构、管辖的纠纷范围、适用的法律、具体的程序)逐一进行了解构和研究。而后结合国际足联官网公布的真实案例,对其内部纠纷解决实践进行了审视。在制度解构这一部分,本章对国际足联3个内部纠纷解决机构——纠纷解决委员会、球员身份委员会、上诉委员会各自管辖的纠纷范围作了划定和区分,并且,依据国际足联制定的《球员身份委员会与纠纷解决委员会程序规则》、《球员身份及转会规则》、《国际足球联合会纪律守则》等对各机构的纠纷解决程序一一作了梳理。第四章对英国、南非、澳大利亚3个国家足球协会的内部纠纷解决机制进行了阐述和剖析。这一章的国别制度研究也是依据“纠纷解决机构—解决的纠纷范围—纠纷解决的程序”这一顺序来展开的,对英格兰足球总会、南非足球协会、澳大利亚足球协会3个国家足球协会的内部纠纷解决机制作了全景式的概览与透视。第五章探讨了我国足球协会内部纠纷解决机制的建立与完善。本章在对我国足球协会现行的内部纠纷解决机制进行考量的基础上,分析了这一纠纷解决机制在体制上和具体制度上存在的缺陷,并结合国际足联专门发布的《国家足协纠纷解决委员会标准规程》这一示范规则,以及别国足协建立内部纠纷解决机制的先进经验和做法,对如何重构并完善我国足球协会内部的纠纷解决机制提出了自己的构想和具体建议。
[Abstract]:With football socialization, commercialization degree more and more high, the football field appeared more and more, more and more complex sports disputes. This article is divided into three parts: introduction, text and conclusion. The body part is divided into five chapters.
The first chapter the basic concepts involved in the thesis are defined and analyzed.
