纠纷格式化:立案过程中的纠纷转化研究

【摘要】：众多既有研究习惯性关注"纠纷及其解决",常常忽略纠纷本身的转化。本文基于对"立案"这一司法程序中纠纷转化环节的剖析,阐释生活世界的诸要素如何通过"纠纷格式化"进入法律世界。在纠纷转化为案件的过程中,系统化的法律逻辑与日常化的生活逻辑的交织互动持续发生,纠纷格式化的内涵包括对纠纷的定性、命名、形式化与文牍化等,并具体呈现为"内部过滤"、"外部包装"两大阶段,"过滤—包装"机制成为立案过程中纠纷转化的核心机制。这显示出主张程序正义的司法程序与约定俗成的惯例在互动中形成了一种互为制约、互为限度的紧张关系,同时也一定程度上实现了法律世界与生活世界的沟通融合。
[Abstract]:Many existing researches focus on "dispute and its resolution", and often ignore the transformation of dispute itself.Based on the analysis of the link of dispute transformation in the judicial procedure, this paper explains how the elements of the life world enter the legal world through "dispute formatting".In the process of transforming the dispute into a case, the interwoven interaction between the systematic legal logic and the daily life logic occurs continuously. The connotation of the dispute formatting includes the qualitative, naming, formalization and writing of the dispute, etc.In the two stages of "internal filtering" and "external packaging", the "filter-packaging" mechanism becomes the core mechanism of dispute transformation in the process of filing a case.This shows that the judicial procedure which advocates procedural justice and the convention established by convention form a kind of tense relationship between mutual restriction and limitation, and at the same time realize the communication and fusion of the legal world and the world of life to a certain extent.
