检察机关银行查询制度研究

【摘要】：银行查询是侦查机关获取证据,打击犯罪时必不可少的一种侦查措施,但它不限于使用于侦查阶段,在职务犯罪侦查中起着十分重要的作用。它具有法律性、主动性、针对性和程序性等特征。但是我国检察机关的银行查询制度存在着诸多问题,如立法缺陷导致银行查询范围窄、网上银行的广泛使用与交易记录不可查询的矛盾等。针对上述问题我们应从立法上和相关制度上去完善检察机关银行查询制度,以打击犯罪、保护国家、集体、公民利益,防止犯罪分子转移罪证和赃款,减少和挽回公共财产损失。从检察机关银行查询权的概念,可以看出我国检察机关银行查询权的法律依据、性质和特征,进而发现检察机关银行查询的基本程序和检察机关银行查询程序设置的意义,但是,我国检察机关银行查询制度和实际运行仍然存在各种问题,因此,需要从制度建设和实践中予以完善。
[Abstract]:Bank inquiry is an indispensable investigative measure for investigating organs to obtain evidence and crack down on crimes, but it is not limited to the stage of investigation and plays a very important role in the investigation of job-related crimes.It has the characteristics of law, initiative, pertinence and procedure.However, there are many problems in the bank inquiry system of the procuratorial organ of our country, such as the limitation of legislation, the contradiction between the extensive use of online bank and the unsearchable transaction record, and so on.In view of the above problems, we should improve the bank inquiry system of procuratorial organs in terms of legislation and related systems in order to crack down on crime, protect the interests of the state, the collective and citizens, and prevent criminals from transferring criminal evidence and stolen money.To reduce and recover the loss of public property.From the concept of the procuratorial bank inquiry right, we can see the legal basis, nature and characteristics of the procuratorial bank inquiry right in our country, and then find out the basic procedure of the procuratorial bank inquiry and the significance of the establishment of the procuratorial bank inquiry procedure.However, there are still various problems in the bank inquiry system and actual operation of procuratorial organs in our country. Therefore, it is necessary to perfect the system construction and practice.
