论司法政策的正当性

【摘要】：司法政策既是制度运行过程中政治与法律相互作用的结果,同时也是一个重新界分现有权力结构、权力关系与格局过程的政策性产物。面对质疑,从形式正当性和实质正当性两条路径,阐释了司法政策实质是最高人民法院行使司法管理权的一种方式。司法政策获得正当性是立法缺位与司法能动下为实现大局司法的必然结果,但其也要得到政治与社会的双重认同。为体现实质正义与程序正义的双重价值,应明确制定程序,引入专家论证和公众参与。
[Abstract]:Judicial policy is not only the result of the interaction between politics and law in the process of system operation, but also the policy product of the process of redividing the existing power structure, power relationship and pattern. In the face of doubt, this paper expounds that the essence of judicial policy is a way for the Supreme people's Court to exercise its judicial management power from the two paths of formal legitimacy and substantive legitimacy. The legitimacy of judicial policy is the inevitable result of realizing the overall situation of justice under the absence of legislation and the action of judicature, but it should also be recognized by both politics and society. In order to reflect the dual value of substantive justice and procedural justice, it is necessary to clearly establish procedures, introduce expert argumentation and public participation.
