论行政诉讼调解制度

【摘要】: 我国行政诉讼法第五十条规定:“人民法院审理行政案件,不适用调解。”根据该条规定,我国是不存在行政诉讼调解制度的。然而,调解制度的生命力并未因为法律的权威性规定而寿终正寝,相反,却以一种非制度化的方式活跃于行政诉讼中。学界对于我国是否应当建立行政诉讼调解制度也莫衷一是。在行政诉讼法即将修改之际,探讨该问题具有极为重要的理论与实践意义。文章认为,在我国建立行政诉讼调解制度不仅仅是司法效率的需要,也更基于现代行政诉讼判决正当化的考量。司法实践中的行政案件撤诉率居高不下、超审限与执行难问题都是对行政诉讼禁止调解之规定的质疑;服务行政理论、“合作论”等现代行政法学理论为调解制度的建立提供了理论依据。在我国建立行政诉讼调解制度已具备了实践基础和理论基础,修改行政诉讼法势在必行。文章从传统法学的角度对调解进行了分析,认为以意思自治原则为前提的调解制度具有私法手段的性质,行政诉讼中的调解属于私法纠纷解决手段在公法中的运用。但公法并不排斥合意,并且在行政诉讼中运用调解不仅不违背公私法划分的目的,甚至还有利于公法目的的实现。而现代公私法关系的变化——二者之间的相互渗透也为行政诉讼调解制度的建立预留了空间。另一方面,从国际上来看,美国的法院附设调解、法国的调解专员制度以及我国台湾地区行政诉讼法中的和解制度,都为我国行政诉讼调解制度的建立提供了可资借鉴的经验;同时,加入WTO组织也对我国行政诉讼调解制度的建立提出了外在要求。因此,我们必须打破观念的枷锁,尽快将调解机制引入到行政诉讼中去。
[Abstract]:Article 50 of China's Administrative procedure Law stipulates: "the people's court shall not apply mediation in handling administrative cases." According to this article, there is no administrative litigation mediation system in China. However, the vitality of the mediation system has not died because of the authoritative provisions of the law. On the contrary, it is active in administrative litigation in a non-institutionalized way. The academic circles are divided about whether our country should establish the administrative litigation mediation system. When the Administrative procedure Law is about to be revised, it is of great theoretical and practical significance to explore this issue. The article holds that the establishment of administrative litigation mediation system in our country is not only the need of judicial efficiency, but also based on the consideration of the legitimacy of modern administrative litigation judgment. In judicial practice, the rate of withdrawal of administrative cases remains high, and the problems of exceeding the limit of trial and the difficulty of enforcement are both doubts about the prohibition of mediation in administrative litigation; the theory of service administration, The modern theory of administrative law, such as the theory of cooperation, provides the theoretical basis for the establishment of mediation system. The establishment of administrative litigation mediation system in our country already has the practice foundation and the theory foundation, it is imperative to modify the administrative procedure law. This paper analyzes mediation from the perspective of traditional jurisprudence, and holds that the mediation system based on the principle of will autonomy has the nature of private law means, and mediation in administrative litigation belongs to the application of private law dispute resolution means in public law. However, public law does not exclude consensus, and the use of mediation in administrative proceedings is not only against the purpose of the division of public and private law, but also conducive to the realization of the purpose of public law. And the change of modern public-private law relationship-the mutual penetration between the two also reserved space for the establishment of administrative litigation mediation system. On the other hand, from the international point of view, the mediation system in the courts of the United States, the mediation commissioner system in France and the conciliation system in the administrative litigation law of Taiwan all provide reference experience for the establishment of the mediation system in administrative litigation in our country. At the same time, China's entry into WTO also puts forward external requirements for the establishment of administrative litigation mediation system in China. Therefore, we must break the shackles of ideas and introduce mediation mechanism into administrative litigation as soon as possible.
