论我国检察解释的现状与存废思考

【摘要】：1981年6月10日五届全国人大常委会第19次会议颁布的《关于加强法律解释工作的决议》(以下简称《决议》)规定：“凡属于法院审判过程中具体应用法律、法令的问题,由最高人民法院进行解释。凡属于检察院检察工作中具体应用法律、法令的问题,由最高人民检察院进行解释。”《决议》颁布后,司法解释在我国得到了空前的发展。这些司法解释对于保证检察机关严格、统一执行法律发挥了积极的作用,但同时其在法理与司法实践中存在的问题日益突出。笔者对2000年至2011年间颁布的检察解释的现状、2011年12月最高人民法院公布指导性案例对检察解释的冲击进行分析,提出不可以一味地废除检察解释,应当对其进一步规范,规范的重点是要严格界定检察解释的范围,处理好其与立法解释、审判解释的关系,使其更好地指导司法实践。
[Abstract]:The Resolution on strengthening legal interpretation (hereinafter referred to as "Resolution"), promulgated by the 19th session of the Fifth National people's Congress standing Committee on June 10, 1981, stipulates: "any specific application of laws and decrees in the course of court trials, Interpretation by the Supreme people's Court. In the procuratorate's procuratorial work, the application of laws and decrees should be interpreted by the Supreme people's Procuratorate. After the promulgation of the Resolution, the judicial interpretation has been developed unprecedentedly in our country. These judicial interpretations play an active role in ensuring that procuratorial organs are strict and uniform in enforcing the law, but at the same time, the problems existing in their jurisprudence and judicial practice are increasingly prominent. The author analyzes the current situation of procuratorial interpretation promulgated from 2000 to 2011, and the Supreme people's Court published guiding cases in December 2011 to analyze the impact of procuratorial interpretation, and points out that procuratorial interpretation should not be abolished blindly, and it should be further standardized. The emphasis of the standard is to strictly define the scope of procuratorial interpretation, deal with its relationship with legislative interpretation and trial interpretation, and make it better guide judicial practice.
