关于司法人员文化修养与公正文明司法的几点思考——兼论厚植防范冤假错案的文化基因

【摘要】：文化的因素和视角对于保障公正文明司法、防范冤假错案非常重要而又容易被忽视。本文着重论述提升司法人员文化修养对于保障公正文明司法、防范冤假错案的基础性、关键性作用。本文认为,与理念、原则、制度相比,文化是决定和衡量司法公正文明程度更深层次的要素,司法人员(1)的文化修养与司法公正文明之间存在十分密切的内在逻辑关系,这是由文化的特性所决定的。必须清醒认识、牢牢把握司法机关文化建设和司法人员文化修养的基础性地位,将其置于更加突出的位置,常抓不懈,以司法人员的文化修养建设滋养和推进他们的政治、法律、道德修养和职业精神,真正实现公正文明司法"内化于心,外化于行"。本文提出司法人员文化修养在构成上应当区分的两个层次,司法人员文化修养建设四个方面的特殊路径以及应当着重解决的五个方面的突出问题。
[Abstract]:Cultural factors and angles of view are very important and easy to be ignored in order to ensure fair and civilized justice and prevent unjust and false cases. This paper focuses on the fundamental and critical role of improving the cultural accomplishment of judicial personnel in safeguarding the just and civilized administration of justice and in preventing unjust and false cases. This paper holds that, compared with ideas, principles and systems, culture is a deeper factor to determine and measure the civilization of judicial justice, and there is a very close logical relationship between the cultural accomplishment of judicial personnel and the civilization of judicial justice. This is determined by cultural identity. We must clearly understand that we must firmly grasp the basic position of the cultural construction of judicial organs and the cultural accomplishment of judicial personnel, place it in a more prominent position, constantly grasp it, and nourish and promote their politics with the cultural cultivation of judicial personnel. Law, moral cultivation and professional spirit, the true realization of fair and civilized justice "internalization in the mind, externalization in the action." This paper puts forward two levels that should be distinguished in the constitution of judicial personnel's cultural accomplishment, the special path in four aspects of the construction of judicial personnel's cultural accomplishment, and the outstanding problems in five aspects that should be solved emphatically
