土地征收纠纷案件存在的司法困境及其出路

【摘要】：近年来,随着社会经济的飞速发展,城市化建设步伐加快,城市向周边农村蔓延成为一种发展趋势,农村土地征收进入白日化阶段。土地这一不可再生性资源日渐消逝,失地农民不断增多,因土地征收引发的利益冲突扩大,社会矛盾加剧。伴随而来的是征地款的分配引发的一系列纠纷案件,给我们的司法带来了严峻的考验,也成为了司法界关注的焦点。但是,法院对土地征收纠纷案件的审理面临着诸多挑战。笔者经过近一年的法院实习,对近几年来基层法院审理土地征收纠纷案件的实际情况,查阅了相关案卷,有针对性的进行总结、分析,参与该类案件的实际审理过程,与承办法官共同调研,实地走访被征收土地的村庄,与村民面对面交流,旨在为法院处理该类纠纷司法实务提供参考。在因农村土地征收引发的诸多纠纷中,农村土地被征收后所得补偿费的分配问题表现最为突出,因该类案件的处理缺乏明确的法律依据,随意性较大,给实务界操作带来一定的困难。不仅难以使当事人服判息讼,也会导致大量越级上访、群体上访事件发生,给社会稳定埋下不安定因素。因此,笔者以基层法院为例,在剖析土地征收基本内涵的基础上,着眼于基层法院历年来关于土地征收纠纷案件审理的实际情况,解读基层法院在审理土地征收纠纷案件碰到的司法困境,探究纠纷产生背后的深层次原因,从理论上构筑纠纷的司法实践解决方案。土地征收纠纷案件的司法出路探讨是一个持续发展和逐步完善的渐进过程,任重而道远。通过此课题的研究,以期与社会同仁共勉,进一步健全和完善我国基层法院审理土地征收纠纷案件的司法出路,以维护农村稳定,推动农村经济持续发展。
[Abstract]:In recent years, with the rapid development of social economy and the acceleration of urbanization, the spread of cities to surrounding rural areas has become a development trend, rural land expropriation has entered the stage of day. Land, a non-renewable resource, is disappearing day by day, the land-lost farmers are increasing, the conflicts of interest caused by land expropriation are expanding, and the social contradictions are becoming more and more serious. Accompanied by a series of disputes caused by the allocation of land requisition, it brings us a severe test and becomes the focus of judicial attention. However, the court of land expropriation dispute cases are facing many challenges. After nearly a year of court practice, the author consulted the relevant case files, summarized, analyzed and participated in the actual trial process of this kind of cases in the grass-roots courts in recent years. In order to provide reference for the judicial practice of court dealing with this kind of disputes, the author makes a joint investigation with the host judge, visits the villages where the land is expropriated, and communicates with the villagers face to face. Among the disputes caused by the expropriation of rural land, the distribution of compensation after the expropriation of rural land is the most prominent, because of the lack of clear legal basis for the handling of this kind of cases, it is arbitrary. It brings some difficulties to the operation of practical circles. It is not only difficult to make the litigant serve interest, but also lead to a large number of overstepping petition, group petition events, social stability buried unstable factors. Therefore, taking the grass-roots courts as an example, on the basis of analyzing the basic connotation of land expropriation, the author focuses on the actual situation of the cases concerning land expropriation disputes handled by grass-roots courts over the years. This paper interprets the judicial difficulties encountered by the grass-roots courts in handling disputes over land expropriation, probes into the deep-seated reasons behind the disputes, and constructs theoretically the judicial practical solutions to disputes. The judicial outlet of land expropriation disputes is a gradual process of continuous development and gradual improvement, and it has a long way to go. Through the research of this subject, the author hopes to further improve and perfect the judicial outlet for the trial of land expropriation dispute cases by the grass-roots courts in our country, in order to maintain the rural stability and promote the sustainable development of rural economy.
