【摘要】：随着港澳的回归和“一国两制”方针的贯彻实施,中国逐渐演变成了一个多法域的国家。与之相应,区际司法协助问题也就提上了议事日程。澳门回归后,两地间的经贸和民间交往不断发展,涉及两地的民商事诉讼和相关法律事务也有所增多,这就要求两地加强民商事区际司法协助。本文通过对内地和澳门的民商事司法协助的研究,希望能够为两地加强民商事司法协助提供参考。本文由导论、正文和结论三部分组成,正文分为四章,主要内容依次为：第一章概述中国内地和澳门民商事区际司法协助。首先对区际司法协助的内涵和外延进行了初步的理论说明,然后对我国内地和澳门民商事区际司法协助进行概要阐述。第二章介绍了中国内地和澳门民商事司法协助的法律依据和现状。分别从宪法性法律、区域民商事司法协助协议、中国内地和澳门的本地法律来解释中国内地和澳门民商事司法协助的法律依据,然后进一步说明在这些法律依据之下的两地民商事司法协助的现状。第三章是内地和澳门民商事司法协助面临的主要问题及其原因。由于中国内地和澳门在社会制度、司法体制、法律文化传统等方面的差异非常明显,所以两地在民商事司法协助方面面临很多困难和阻碍。本部分通过对存在的主要问题进行分析,找出其存在的原因。第四章是完善中国内地和澳门民商事区际司法协助的设想。这是针对两地在民商事司法协助面临的主要问题提出的解决方案,就完善两地民商事司法协助应该坚持的原则,如何具体完善两地现有区际司法协助内容等提出设想。
[Abstract]:With the return of Hong Kong and Macao and the implementation of the principle of "one country, two systems", China has gradually evolved into a multi-jurisdiction country. Accordingly, the issue of regional mutual legal assistance has been put on the agenda. After Macao's return to China, the economic and trade and folk exchanges between the two places have been developing continuously, and the number of civil and commercial litigation and related legal affairs has also increased, which requires the two places to strengthen judicial assistance between the two regions. Through the research on the judicial assistance in civil and commercial affairs in the mainland and Macao, this paper hopes to provide a reference for strengthening judicial assistance in civil and commercial matters. This paper consists of three parts: introduction, text and conclusion. The text is divided into four chapters. The main contents are as follows: The first chapter summarizes the inter-regional judicial assistance between the mainland of China and Macao. At first, the connotation and extension of inter-regional judicial assistance are explained in theory, and then the interregional judicial assistance in civil and commercial affairs of mainland China and Macao is briefly expounded. The second chapter introduces the legal basis and present situation of judicial assistance in civil and commercial affairs in mainland China and Macao. To explain the legal basis for mutual legal assistance in civil and commercial matters in the mainland of China and Macao in terms of constitutional law, regional agreements on mutual legal assistance in civil and commercial matters, and local laws in the mainland of China and Macao, respectively. Then it further explains the current situation of mutual legal assistance in civil and commercial affairs under these legal bases. The third chapter is the main problems and reasons of the civil and commercial judicial assistance in the mainland and Macao. Because the differences between mainland China and Macao in social system, judicial system, legal cultural tradition and so on are very obvious, the two places face a lot of difficulties and obstacles in civil and commercial judicial assistance. In this part, the main problems are analyzed to find out the reasons for their existence. The fourth chapter is to improve the mainland of China and Macao inter-regional judicial assistance. This is a solution to the major problems faced by judicial assistance in civil and commercial affairs in both places. It also puts forward some ideas on how to perfect the principles of mutual legal assistance in civil and commercial matters and how to improve the contents of mutual legal assistance between the two regions.
