风险管理:基于司法风险案件典型样本分析的理性考量

【摘要】：从五个风险案件典型样本切入,运用文献分析研究方法,从风险认知的视角系统梳理了案件司法风险的基本类型、风险特征,考量了司法风险的产生诱因及其传播特征。进而根据风险管理理论,构建了以司法风险预警评估制度、司法风险管理制度和司法风险沟通制度为核心的司法风险管理机制,全面规避、消解和防范司法风险。
[Abstract]:From five typical samples of risk cases, this paper systematically combed the basic types and risk characteristics of judicial risks in cases from the perspective of risk cognition by using the method of literature analysis and research, and considered the causes and propagation characteristics of judicial risks. Then, according to the risk management theory, a judicial risk management mechanism, which is based on the judicial risk early-warning evaluation system, judicial risk management system and judicial risk communication system, is constructed to avoid, eliminate and prevent judicial risks in an all-round way.
