涉法涉诉信访制度之探析

【摘要】：当前我国正处于社会高速发展时期，人民经济生活水平日益提高，法律意识不断增强，但是也带来了一些新的问题，尤其是贫富差距越来越大，社会矛盾尖锐。涉法涉诉信访案件近年来居高不下，成为当前我国法律制度中的一大问题。由于涉法涉诉信访自古代就有其存在的方式和法律依据，在我国一直是基层群众维护自己的合法权益的途径和方式，我国法律也一直给予认可和支持。但是由于我国司法制度的不完善，涉法涉诉信访制度也不健全，涉法涉诉信访制度与民事调解制度、再审制度分工不明，责任不清，造成了很多的重复信访，极大的浪费了社会资源，而且还无法维持案件裁判的终局性，法律的效力无法溯及。本文以某市中级人民法院的信访案例为对象，研究涉法涉诉信访的概念，，特点，成因、现状和瓶颈来探讨涉法涉诉信访问题，并进一步提出解决此类问题的对策及出路。即确保涉法涉诉信访制度与调解制度相结合，更好的解决群众的信访问题，维护群众的合法权益。明确再审制度的次数和审查程序，设立涉法涉诉信访终结机制。
[Abstract]:At present, our country is in the period of rapid social development, the people's economic living standard is improving day by day, the legal consciousness is being strengthened constantly, but also has brought some new problems, especially the gap between the rich and the poor is getting wider and bigger, the social contradiction is sharp. In recent years, the law-related litigation cases remain high, which has become a major problem in the current legal system of our country. Because of the way of existence and legal basis since ancient times, it has always been the way and way for the grassroots people to safeguard their legitimate rights and interests in our country, and the law of our country has always given recognition and support. However, due to the imperfection of our judicial system, the system of litigation, petition and petition is not perfect, the system of litigation, petition and civil mediation, the system of retrial is not clear and the responsibility is not clear, which has resulted in a lot of repeated letters and visits. A great waste of social resources, but also unable to maintain the final nature of the case, the effect of the law cannot be traced back. In this paper, the author studies the concept, characteristics, causes, present situation and bottleneck of the petition cases of the intermediate people's court in a certain city, and further puts forward the countermeasures and ways to solve the problems. That is, to ensure the system of litigation and petition and mediation system to better solve the problem of the masses, to protect the legitimate rights and interests of the masses. Make clear the times and examination procedure of retrial system and set up the mechanism of termination of petition and petition.
