检察机关人民监督员制度的现实考察

【摘要】:人民监督员制度是为完善检察机关自侦案件的办理机制,促进检察工作健康发展而推行的一项外部监督机制。从2003年高检院开始启动该项试点工作,到2010年10月此项制度的全面推行,取得了为社会各界广为称赞的成果。人民监督员制度的建立健全,对于进一步促进我国检察工作的机制完善,推进民主法治进程有着极为深刻的影响。人民监督员制度在基层检察院有着较为广泛的应用,也对基层检察机关办案有着深远的影响。从人民监督员制度在基层检察机关中的做法和经验、成绩和不足、探索和完善出发,我们可以从一个侧面对人民监督员制度在实践中的现状进行显示考察,探求完善制度的建议和对策。 可以说,人民监督员制度从建立之初起,就显示了其独有的作用,既不同于普通的社会舆情监督,也不同与人大的依法监督。为了对该种独有的作用进行一个较为清晰的认知,我们对人民监督员制度的概念、产生的根源与背景以及制度的具体内容进行了解读,并结合当前社会诸多学者对人民监督员制度的认识,尝试分析该种制度的基本特点。 人民监督员制度从试点到全面推行经历的发展阶段,正是该种制度逐步走向成熟的一个过程。从人民监督员制度在基层检察院的实践来看,具体来说,从其在实践中人民监督员的选任、案件监督以及该种制度取得的成效等来看,都能折射出该种制度的走向、变化。对这种制度在发展历程中呈现的潜在特点进行总结分析,探讨其对检察机关自侦案件办理的现实作用,分析其存在的合法性、合理性,同时,对其在实践中暴露的问题,如启动程序、监督权利行使的主动性,案件评议后的落实效力问题以及人民监督员办公保障等问题,进行总结和归纳,分析出其中的不足,利于我们提出解决相应问题的意见和建议。 人民监督员制度作为人民群众有效参与国家管理、参与国家事务的一种方式,作为检察机关听取人民群众意见、接受群众监督的一种渠道、一种途径,必将更加成熟完善,最终走上立法之路,充分发挥其固有的作为,为推动我国的民主法治建设进程作出积极的贡献
[Abstract]:The people's Supervisor system is an external supervision mechanism to perfect the handling mechanism of procuratorial organs' self-investigation cases and to promote the healthy development of procuratorial work. From the beginning of the trial work in 2003 to the full implementation of the system in October 2010, the institute has achieved a result that has been widely praised by all circles of the society. The establishment and perfection of the people's Supervisor system has a profound influence on the improvement of the procuratorial work mechanism and the process of democracy and the rule of law in China. The system of people's supervisors has been widely used in the basic procuratorates and has a profound influence on the procuratorial organs. Starting from the practice, experience, achievements and deficiencies of the people's Supervisor system in the grass-roots procuratorial organs, we can explore and improve the current situation of the people's Supervisor system in practice from one side. Probe into the suggestion and countermeasure of perfecting the system. It can be said that from the beginning of its establishment, the people's Supervisor system has shown its unique role, which is not only different from the ordinary supervision of social public opinion, but also different from the legal supervision of the people's Congress. In order to have a clear understanding of this unique role, we interpret the concept of the people's Supervisor system, the origin and background of the system, and the specific contents of the system. Combined with the current understanding of the people's Supervisor system, this paper tries to analyze the basic characteristics of the system. The development stage of the people's Supervisor system from pilot to full implementation is a process of gradual maturity of the system. From the point of view of the practice of the people's Supervisor system in the grass-roots procuratorate, specifically, the selection and appointment of the people's Supervisor in practice, the supervision of the case and the effect of the system, all can reflect the trend and changes of the system. This paper summarizes and analyzes the potential characteristics of this system in the course of development, probes into its practical role in handling self-investigating cases of procuratorial organs, analyzes the legitimacy and rationality of its existence, and at the same time, discusses the problems exposed in practice. For example, starting the procedure, the initiative of supervising the exercise of the right, the effectiveness of the implementation after the case review and the office security of the people's supervisors, etc., are summarized and summarized, and the deficiencies are analyzed. It is advantageous for us to put forward suggestions and suggestions for solving the corresponding problems. The system of people's supervisors, as a way for the masses to effectively participate in the management of the state and participate in state affairs, as a channel for procuratorial organs to listen to the opinions of the masses and accept supervision by the masses, is bound to become more mature and perfect. Finally, take the road of legislation, give full play to its inherent work, and make positive contributions to the process of promoting the construction of democracy and the rule of law in our country.
