社会管理创新背景下法律服务问题研究

【摘要】：构建社会主义和谐社会是我们党和政府不断追求并为之奋斗的重要目标。当今社会，随着改革开放的深入，经济和社会飞速发展并不断进步，社会利益诉求日益多样化，原有的利益格局发生着深刻而又显著的变化，出现了一些新的社会阶层，不同社会主体之间发生着错综复杂的利益摩擦，引发了各种新的社会矛盾和社会问题，影响了经济和社会的健康协调发展，并对政治稳定产生了一定的威胁。这就要求各级政府深入探索和研究社会管理规律，加强社会管理体制创新，加快完善社会管理的政策和法规，创新社会管理方法，整合社会资源，激发社会活力，提高社会管理的水平和能力。在社会管理创新背景之下的法律服务研究，是社会管理创新的一个重要层面和内容，为社会管理创新提供法律支持和保障，促进社会管理创新在法治框架下合理有序地进行。如何在社会管理创新背景下充分发挥法律服务职能的作用，解决好新时期社会管理中的新情况和新问题，正是本文所要探讨的。本文对社会管理创新和法律服务进行了比较深入和系统地研究。首先阐述了研究背景及意义、国内外研究状况综述以及研究方法与研究内容。其次，本文从对社会管理及其创新的内涵、法律服务的内涵及范围进行科学界定入手，阐述了社会正义理论、服务型政府理论、依法行政理论和法律公平理论，，并运用这些理论分析了社会管理创新对法律服务的价值诉求。再次，结合我国当前社会管理创新背景下法律服务的基本实践分析了其存在的主要问题，并针对我国社会管理创新背景下法律援助工作机制不科学、社会弱势群体的法律服务未真正务实、城乡一体法律服务工作体系尚未建立、人民调解存在诸多不足等具体问题，进行了较为深入的原因剖析。然后对当前其他社会管理较为创新的国家如美国、英国、法国的法律服务方面的基本做法和经验进行总结，提出了健全和完善法律援助工作机制,切实做好针对社会弱势群体的法律服务工作,加快建立城乡一体的法律服务工作体系,充分发挥人民调解制度在法律服务工作中的活力等具体措施，具有一定的普遍适用意义。
[Abstract]:Building a harmonious socialist society is an important goal for our party and government to pursue and strive for. In today's society, with the deepening of reform and opening up, the rapid development and continuous progress of economy and society, the demands of social interests are increasingly diversified, the original pattern of interests has undergone profound and significant changes, and some new social strata have emerged. The intricate interest friction among different social subjects has caused various new social contradictions and social problems, affected the healthy and coordinated development of economy and society, and threatened the political stability. This requires governments at all levels to deeply explore and study the laws of social management, to strengthen the innovation of social management systems, to speed up the improvement of social management policies and regulations, to innovate social management methods, to integrate social resources, and to stimulate social vitality. Improve the level and ability of social management. The research on legal service under the background of social management innovation is an important aspect and content of social management innovation, which provides legal support and protection for social management innovation, and promotes social management innovation to be carried out reasonably and orderly under the framework of the rule of law. How to give full play to the function of legal service under the background of social management innovation and how to solve the new situation and new problems in social management in the new period is exactly what this article will discuss. This paper makes a deep and systematic study on social management innovation and legal service. First of all, the research background and significance, domestic and foreign research status, research methods and research content are described. Secondly, from the connotation of social management and its innovation, the connotation and scope of legal service, this paper expounds the theory of social justice, the theory of service-oriented government, the theory of administration according to law and the theory of legal fairness. And use these theories to analyze the value demand of social management innovation to legal service. Thirdly, combined with the basic practice of legal service under the background of current social management innovation, this paper analyzes its main problems, and aims at the unscientific mechanism of legal aid work under the background of social management innovation in our country. The legal services of the social vulnerable groups are not really pragmatic, the system of legal services in urban and rural areas has not yet been established, and there are many shortcomings in the mediation of the people. Then it summarizes the basic practices and experiences of other countries with relatively innovative social management, such as the United States, Britain and France in legal services, and puts forward a sound and perfect legal aid working mechanism. It is of universal significance to do the legal service work well for the vulnerable groups of the society, to speed up the establishment of the legal service system integrating urban and rural areas, and to give full play to the vitality of the people's mediation system in the legal service work.
