人民陪审员制度的社会演化论分析

【摘要】：人民陪审员制度对于促进司法公正、预防司法腐败以及培养公民的法治意识等具有重要意义,并在当今中国的法治社会建设中扮演着越发重要的角色。近年来,人民陪审员制度的改革速度加快,这与多方面因素存在关联。首先,改革开放日益深化加速社会环境的开放,增大人民陪审员制度发展的可能,给其演化提供诸多有利的选择;其次,党和国家领导人在观念上的重视推动着人民陪审员制度的演进过程,使其得以进一步发展;最后,中国特色社会主义法律体系的日益完善也带动着人民陪审员制度的不断进步。虽然人民陪审员制度不断向前发展,但是人民陪审员制度在司法实践中也受到包括思想观念的束缚、利益因素的制约以及相关制度建构方面的不足等在内的多方面因素的影响。尽可能地探索这些问题的成因并找出一条适合我国国情和时代需求的人民陪审员制度发展之路,对于其作用的有效发挥以及人民陪审员制度的改革具有重要意义。
[Abstract]:The system of people's jurors is of great significance for promoting judicial justice, preventing judicial corruption and cultivating citizens' awareness of the rule of law, and plays an increasingly important role in the construction of the society of ruling by law in China. In recent years, the speed of the reform of the people's jury system has been accelerated, which is related to many factors. First, deepening reform and opening up to accelerate the opening up of the social environment, increasing the possibility of the development of the people's jury system, providing many favorable options for its evolution; secondly, The importance attached by the Party and state leaders to the concept of the people's jury system promotes the evolution of the people's jury system and makes it develop further. Finally, the improvement of the socialist legal system with Chinese characteristics also leads to the continuous progress of the people's jury system. Although the people's jury system develops continuously, the people's jury system is also affected by many factors in judicial practice, including the restriction of ideology, the restriction of benefit factor and the deficiency of related system construction. It is of great significance to explore the causes of these problems and find out a way to develop the people's jury system which is suitable for our country's national conditions and the needs of the times, which is of great significance for the effective exertion of its function and the reform of the people's jury system.
