两岸司法互助若干问题研究

【摘要】：随着海峡两岸经贸交流和人民往来日益频繁,两岸之间的跨境犯罪也逐渐增多,从而阻碍两岸和平发展的进程。所以加强海峡两岸司法互助,共同打击犯罪是两岸交流合作的现实需要。由于海峡两岸历史遗留的问题,致使两岸司法互助具有自身的特殊性。两岸司法互助完全是一个主权国家内部的司法协作问题,它属于同一个国家内部不同法域之间的区际司法协助。2009年4月26日海协会与海基会在南京举行了“江陈会谈”,会中签署《海峡两岸共同打击犯罪及司法互助协议》,深化了两岸在共同打击犯罪以及司法互助上的合作。本文以《海峡两岸共同打击犯罪及司法互助协议》为分析出发点,对“协议”在文本上的不足、及“协议”在实施中会遇到的问题进行分析,并对两岸司法互助实务中针对两岸跨境有组织犯罪、两岸跨境毒品犯罪、两岸司法文书送达、两岸司法调查取证与证据采信制度、两岸民商事裁决的认可与执行等问题进行研究。
[Abstract]:With the increasingly frequent economic and trade exchanges and people exchanges between the two sides of the Taiwan Strait, cross-border crimes between the two sides of the strait are also gradually increasing, thus hindering the process of peaceful development of the two sides of the strait. Therefore, strengthening the two sides of the strait mutual legal assistance and joint fight against crime is a practical need for cross-strait exchanges and cooperation. Due to the problems left over by the history of the two sides of the Taiwan Strait, mutual legal assistance between the two sides of the Taiwan Strait has its own particularity. Mutual legal assistance between the two sides of the strait is entirely a matter of judicial cooperation within a sovereign state. It belongs to interregional judicial assistance between different jurisdictions within the same country. On 26 April 2009, ARATS and the Straits Exchange Foundation held "Jiang Chen talks" in Nanjing. The signing of the Agreement on Joint Combating Crime and Mutual legal Assistance between the two sides of the Taiwan Strait deepened cross-strait cooperation in the joint fight against crime and mutual legal assistance. Based on the "Agreement on Combating Crime and Mutual legal Assistance between the two sides of the Taiwan Strait" as the starting point, this paper analyzes the deficiencies in the text of the Agreement and the problems encountered in the implementation of the Agreement. And to cross-straits cross-border organized crime, cross-border drug crime, cross-strait judicial documents service, cross-Strait judicial investigation, evidence collection and evidence acceptance system in the practice of mutual legal assistance between the two sides of the Taiwan Strait. The recognition and enforcement of civil and commercial awards on both sides of the strait are studied.
