中外检察权比较研究之反思

【摘要】：本文研究中外检察权是从历史的角度出发,追本溯源、由古即今,从检察权的起源与发展着手研究其历史、现状和未来,从封建时期“检察权”的起源一直到近现代检察权的发展,探讨大陆法系、英美法系、社会主义法系之间检察权的种种区别与联系,思考古代御史制度及法律文化对现代检察权的指导意义,发现国外检察权值得借鉴的地方,从而为我国未来检察权的构建和发展提供建议。不忘记基本的历史联系,通过历史的比较的方法是必要且可行的研究方法,研究该问题应当观察检察权的历史起源、发展历程以及在不同界域的区别与联系,才能得出检察权产生的原因,通过追本溯源、抽丝剥茧,方能深入了解问题背后的真谛,从而明确检察权的未来发展轨迹并提出可行的指导建议。以检察权为重心的我国现当代检察制度脱胎于古代御史制度,吸收了大陆法系检察制度的部分精华,借鉴了前苏联检察制度并吸纳了列宁法律监督思想,历经了新民主主义革命时期的探索与实践,新中国成立后经过六十多年发展变化形成。只有通过立足于我国独特的政治制度和文化传统,比较考察检察权的历史源头和演进历程,才能更准确地定位我国的检察权,为我国检察权的构建提出更具改革性的建议。本文比较研究了检察权的中外理论基础,同时选取作为检察权的重要权能之一的刑事职权,从现实意义上比较了不同界域检察权的刑事职权,文章力图通过以历史的、比较的方法研究检察权,目的是反思我国检察权的现状,从而为我国检察权的改进提供可行建议,加强检察权在刑事诉讼律制度中的作用,推进依法治国的重要进程,追求社会公平和国家正义。
[Abstract]:This article studies the procuratorial power in China and abroad from the historical point of view, tracing back to the source, starting with the origin and development of the procuratorial power from ancient to present, and studying its history, present situation and future. From the origin of "procuratorial power" in feudal period to the development of procuratorial power in modern times, this paper probes into the differences and connections of procuratorial power between civil law system, common law system and socialist law system. This paper considers the guiding significance of ancient imperial history system and legal culture to modern procuratorial power, and finds out that foreign procuratorial power is worthy of reference, thus providing suggestions for the construction and development of procuratorial power in the future of our country. Bearing in mind the basic historical links, the method of historical comparison is a necessary and feasible method of research, and the study of this issue should observe the historical origin, the course of development and the differences and connections in different boundaries of procuratorial power, In order to get the reasons of procuratorial power, through tracing back to the source, pulling the cocoon, we can deeply understand the true meaning of the problem, and then make clear the future development track of the procuratorial power and put forward feasible guidance suggestions. The modern and contemporary procuratorial system, which focuses on procuratorial power, was born out of the ancient imperial history system, absorbed part of the essence of the procuratorial system of the continental law system, borrowed from the former Soviet prosecutorial system and absorbed Lenin's thought of legal supervision. After the exploration and practice in the period of the new democratic revolution, the new China was formed after more than 60 years of development and change. Only by comparing and investigating the historical origin and evolution of procuratorial power based on our unique political system and cultural tradition can we more accurately locate the procuratorial power in our country and put forward more reforming suggestions for the construction of procuratorial power in our country. This paper compares the theoretical basis of procuratorial power between China and foreign countries, and selects criminal authority, which is one of the important powers of procuratorial power, to compare the criminal authority of procuratorial power in different areas in reality. The purpose of the comparative study of procuratorial power is to reflect on the present situation of procuratorial power in our country, so as to provide feasible suggestions for the improvement of procuratorial power in China, to strengthen the role of procuratorial power in the criminal procedure law system, and to promote the important process of governing the country according to law.
