行政诉讼检察监督性质、功能及制度完善

【摘要】：行政诉讼检察监督在我国来说还是一个比较新的课题,学界关于行政诉讼检察监督权的性质众说纷纭,至今没有取得一致的意见;司法实践中,检法两家对行政诉讼检察监督的不同理解,限制了行政诉讼中检察监督功能的发挥;立法者对行政诉讼检察监督的制度设计也存在着缺陷,使得检察机关在行政诉讼中的法律监督作用被大大削弱。在行政诉讼检察监督的理论研究和制度设计过程中,首要的是厘清行政诉讼检察监督权的性质:在现代司法观念中,司法是诉讼中的执法,结合检察机关在我国宪政中的法律监督机关的定位,我们认为行政诉讼检察监督权的性质是司法监督权,是司法权的本性和法律监督权的特性相结合的统一体。由此我们也推导出行政诉讼检察监督权的功能就是:法律监督功能、权力制衡功能和人权保障功能。厘清了行政诉讼检察监督权性质和功能,我们就能认识到行政诉讼检察监督制度的缺陷在于赋予检察机关检察监督的权力过少,检察机关不能有效地对行政诉讼进行法律监督。因此有必要赋予检察机关相应的权力对行政诉讼进行全方位、全过程的监督,完善行政诉讼检察监督的相关制度,使检察机关的检察监督在和谐社会建设中发挥更多的作用。
[Abstract]:The procuratorial supervision of administrative litigation is still a relatively new subject in our country. There are different opinions on the nature of procuratorial supervision power in administrative litigation in academic circles, so far there is no unanimous opinion; in judicial practice, The differences in understanding of procuratorial supervision in administrative litigation between the two procuratorates limit the function of procuratorial supervision in administrative litigation, and the system design of procuratorial supervision in administrative litigation by legislators also has defects. So that the procuratorial organs in the administrative proceedings in the role of legal supervision has been greatly weakened. In the process of theoretical research and system design of procuratorial supervision in administrative litigation, the most important thing is to clarify the nature of procuratorial supervision power in administrative litigation: in modern judicial concept, judicature is law enforcement in litigation. Combined with the position of the procuratorial organ in our constitutional government, we think that the nature of the procuratorial supervision power in administrative litigation is judicial supervision power, which is the unity of the nature of judicial power and the characteristics of legal supervision power. The functions of procuratorial supervision power in administrative litigation are legal supervision function, power balance function and human rights guarantee function. By clarifying the nature and function of the procuratorial supervision power in administrative litigation, we can realize that the defects of the procuratorial supervision system in administrative litigation lie in the fact that the procuratorial supervision power of procuratorial organ is too little, and the procuratorial organ can not effectively carry on the legal supervision over administrative litigation. Therefore, it is necessary to endow the procuratorial organ with the corresponding power to carry on the omni-directional, the entire process supervision to the administrative lawsuit, consummates the related system of the procuratorial supervision of the administrative litigation, and makes the procuratorial supervision of the procuratorial organ play a more important role in the construction of the harmonious society.
