【摘要】：法律援助作为法治国家保障人权的重要手段在我国法治建设中的地位和作用日趋重要。高校法律援助作为中国法律援助制度的重要组成部分,是以包括本科生、硕士生和博士生在内的高校大学生为主体,以高校资源为依托,面向社会,无偿为社会弱势群体提供公益性法律服务的法律援助形态之一。一般来说,高校法律援助很少有政府、社会等外部力量的参与,主要是学生自发组织,再加上高校教师及学校的部分支持。高校法律援助中心的法律志愿者群体,以法律人之理性、秉法律之品格、奉法治之使命、承法权之事业,始终关注着弱势群体的权益,坚持法律援助服务,在捍卫公民的合法权益方面做出了较大贡献。湖南大学法律援助中心是由湖南省司法厅批准成立的具有法律援助资格的法律实践基地,是湖南大学内设的法律援助机构,自2003年成立至今已进入较为稳定的发展阶段。通过对法律援助中心工作进行全方位的实证考察,旨在总结成绩和经验,挖掘实践中存在的问题,并提出具体的改进建议。同时,通过研究法律援助中心办案学生处理的典型、疑难案件及其反映的社会基层矛盾,折射高校法律援助的困境,以期对该中心的发展提供相关的对策性建议。
[Abstract]:As an important means of protecting human rights in a country ruled by law, legal aid plays an increasingly important role in the construction of rule of law in China. As an important part of China's legal aid system, college legal aid is based on university students, including undergraduates, master students and doctoral students. One of the forms of free legal aid for social vulnerable groups to provide public welfare legal services. Generally speaking, there are few external forces such as government and society to participate in the legal aid of colleges and universities, mainly by the spontaneous organization of students, plus some support from teachers and schools in colleges and universities. The legal volunteer group of the legal aid center of the university, with the rationality of the legal person, the character of the law, the mission of the rule of law and the undertaking of the legal right, always pay attention to the rights and interests of the vulnerable group, and insist on the legal aid service. It has made great contributions in safeguarding the legitimate rights and interests of citizens. The legal Aid Center of Hunan University is a legal practice base with legal aid qualification approved by the Department of Justice of Hunan Province. It is a legal aid institution set up in Hunan University. Since its establishment in 2003, it has entered a relatively stable stage of development. Through the omni-directional empirical investigation on the work of the legal Aid Center, this paper aims at summing up the achievements and experiences, excavating the existing problems in practice, and putting forward some concrete suggestions for improvement. At the same time, by studying the typical and difficult cases handled by the students of the legal Aid Center and the social grass-roots contradictions reflected by them, the difficulties of the legal aid in colleges and universities are reflected, so as to provide relevant countermeasures for the development of the legal Aid Center.
